Roberson County, NC - Will of Gilbert Lovett - 1926 ~~~~~~~~~~~~~~~~~~ State of North Carolina Robeson County Last Will and Testimony of Gilbert Lovett I, Gilbert Lovett of the County of Robeson and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence do make, publish and declare this my last will and testament in manner and form following, that is to say: 1. My executrix hereinafter named give my body a decent burial suitable to the wishes of my friends and relatives and pay all funeral expenses together with all my just debts out of the first money that shall come into her hands belonging to my estate. 2. I give, devise and bequeath unto my wife, Nolie Lovett during the term of her natural life 48 acres of land where I now live and a being part of the tract of land I got from my father Benjamin Lovett, said 48 acres to be taken off of the land adjoining Len Lovett, and after the death of my said wife, Nolie Lovett I give and devise said lands to my nephew, Ambrose Lovett son of my brother Lenru Lovett to have and hold the same in fee-simple. 3. The balance of my land in Britt's Township and lying on the upper side of said tract I give to my niece, Pennie Davis to be hers and her heirs in fee simple forever. 4. I give, devise and bequeath unto my said wife, Nolie Lovett all and singular my personal property of every kind and description wheresoever the same may be located to have and hold to herself absolutely and forever. 5. And lastly, I do hereby constitute and appoint my beloved wife, Nolie Lovett my lawful executrix, to execute this my last will and testimony and every part and clause of the same hereby revoking and declaring uterly void all other wills and testaments by me here- tofore made. In witness whereof, I, the said Gilbert Lovett have hereunto set my hand and seal this the 19th, day of January 1922. Gilbert Lovett Signed, sealed, published and declared by the said Gilbert Lovett to be his last will and testament in the presence of us who at his request and in the presence of each other have signed our names as witnesses hereto. Britt State of North Carolina In the Superior Court before the Clerk Robeson County September 20, 1926 A paper writing, purporting to be the Last Will and Testament of Gilbert Lovett, deceased, is exhibited for probate, before Theresa Patterson, Asst. Clerk of the Superior Court for said County, and the due execution by the said Gilbert Lovett is proved by the oath and examination of E.J. Britt and L.J. Britt, the subscribing witnesses thereto, who testify, in substance, as follows: That Gilbert Lovett, the testator aforesaid, signed and sealed the said paper writing in the presence of the said witnesses, and at the time of executing the same and at the time said witnesses subscribed their names as witnesses thereto, said Gilbert Lovett, the testator aforesaid, declared the same to be his Last Will and Testament; and further, that the said testator was at the same time of sound mind and memory, of full age to execute a Will, and not under any restraint to the knowledge or information or belief of witnesses. It is, therefore, considered by the Court that said paper writing and every part thereof is the Last Will and Testament of the said Gilbert Lovett, and the same is ordered to be recorded and filed. And thereupon the said Nolie Lovett, executrix as aforesaid, duly qualified as such by taking the oath required by law. Theresa Patterson Asst.
