All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Shank carolynshank@msn.com May 26, 2007, 4:51 pm Source: Personal Record Written: 1825 IN THE NAME OF GOD, AMEN, I MARGARET McMILLAN of Robeson County and State of North Carolina being weak in body but of sound and perfect mind and memory, blessed by Almighty God in the same, do make and publish this my last will and testament in manner and form following (that is to say) First, I give and bequeath unto my son HECTOR McMILLIAN my negro wench, MILLY and order that after my decease the said wench shall be valued by two or more Freeholders (neighbors) indifferently chosen, and the appraisement money so made, To be equally distributed among my grandchildren, ARCHIBALD'S issue but not to be demanded by them in less than six months after my decease. I give and bequeath unto my son MALCOM, my negro man POMPEY, and after my said son's decease to be the property of my grandchild, DANIEL, son of said MALCOM and further that whatever share of my other property shall become said MALCOM'S after my death, to be equally divided among all his children. I further order and ordain: that all my stock of every description, household furniture and farming utensils, shall be sold to the best advantage by my Executors and equal distributions be made of the money among all my children, male and female. And should there be any corn or provision on the premises at the time of my death, the same to be to the use of my son, HECTOR, also my bay horse, also the _____. I further order and ordain that my Funeral charges be paid out of the cash, that may be in the House at my decease, and that my Executor shall pay Twenty Dollars to each of my daughters and also Twenty Dollars to my grandchild MARY, MALCOM's daughter and should there be any surplus after paying the above legacies (left) my son HECTOR to have the balance. But in case there should not be a sufficiency of Cash to pay the funeral charges and the Twenty Dollars to each of the Legatees as aforesaid then and in that case, they shall have an equal share of the sum left after my Funeral charges are paid. I further order that if there should be any damages awarded against the estate of my husband or his heirs on account of McKASKIL's land, the same shall be paid by my executors before any division of the perishable property takes place. I further order that my grandchild, MARY, MALCOM's daughter, shall have a bed, two pair of blankets, two sheets and two coverlets. Finally, I hereby ordain my Beloved son HECTOR MCMILLAN to be executor of this my last & testament. In Witness whereof I have set my hand and seal to this my last will & testament, this 30th August 1825.
