Robeson County, NC - Will of Isaac Spivey, Sr, 1896 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Will of Isaac Spivey, Sr State of South Carolina Marion County I Isaac Spivey Sr. of the county and State aforesaid, being of sound mind and memory, but considering the uncertainty of my earthly existance do make and de-calre this my last Will and Testament, in manner and form following, that is to say: First, That my executor, herein after named, shall provide a decent burial for my body, suitable to the wishes of my relatives and friends, and pay all funeral expenses together with my just debts howsoever and to whosoever owing, out the monies that may first come into his hands as part of my Estate. Item First - I give and devise unto my beloved wife Hannah Spivey, sixty-seven acres of land in Robeson County, North Carolina, set out by metes and bounds and known as the Hill lands, conveyed to her by Deed of Gift, dated Dec. 17th 1896. For and during the term of her natural life, in satisfaction for and in lieu of her dower and third of land in all my real estate. Also the articles of personal property men-tioned in said Deed of Gift. Item Second - I give and devise to my Grand Son D. E. Spivey all that tract of land on the South-west side of Cow Pen Swamp, known as the Baker land containing Fifty (50) acres. To have and to hold to him and his heirs in fee simple forever. Item Third - I give to my grand daughter Crittie Cook Ten dollars in Cash. Item Fourth - I give and bequeath to my son Wingate E. Spivey all that tract of land whereon he now live lying between Cow Pen Swamp and State line set out by metes and bounds in a Deed of Gift dated 14th day of Jan. 1889. Also all the personal property heretofore given him by me. Item Fifth - I give and bequeath to my son Isaac Spivey, Jr. the tract of land where he now live set out by metes and bounds in a Deed of Gift from me to him dated Jan. 14th 1889, to him and his heirs forever. Also the articlesof per-sonal property heretofore given him by me, as his portion of my Estate. Item Sixth - I give and bequeath to my youngest son J. E. Spivey all that tract of land whewhich he now lives in Robeson County, North Carolina and known as the Holmesville tract, set out by metes and bounds in two Deeds from me to him. Also the Articles of personal property heretofore given him by me as his portion of my Estate. Item Seventh - I give and bequeath to my nine daughters or their legal repre-sentavites, viz: Martha Edmund, Sallie ?? Smith, Elizabeth McKenzie, Dollie McKen-zie, Mary McKenzie, Amanda Grantham, Lettie B. Smith, Fannie L. Spivey and Annie L. Page all the residueof my Estate, real and personal. It is my will and desire that my Executor shall rent or sell as his judg-ment may direct the said undivided property, collect all debts due me ay my death make my said daughters equal in advances. They having received the following amounts To wit - Martha Edwards $100.00 Sallie J. Smith $175.00 Elizabeth McKenzie $140.00 Dollie McKenzie $150.00 Mary McKenzie $75.00 Amanda Grantham $50.00 Lettie B. Smith $50.00 Fannie L. Spivey $25.00 Annie L. Page $25.00. Then the balance of the proceeds of said property to be equally divided among my said nine daughters. In sale of said property, it is my will and desire, that my execu- tor give preference to my heirs. And lastly, I do hereby constitute and appoint my trusty friend J. S. Oliver my lawful Executor to all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the same, and every part and claus thereof. Hereby revoking and declaring utterly void all other wills and tes- taments by me heretofore made. In witness whereof I the said Isaac Spivey Sr. do hereunto set my hand and seal This the 17th day of December, 1896.
