Robeson County, NC - Will of J.E. Spivey, 1913 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Will of J E Spivey State of North Carolina Robeson County I J. E. Spivey of Orrum, of the County and State aforesaid, being of sound mind and memory, but considering the uncertainty of my earthly existance, do make and declare this my last will and testament in manner and form following, that is to say. First That my executor or executrix (hereinafter named) shall provide for my body a decent burial suitable to the wishes of my relatives and friends and pay all funeral expenses, together with my just debts, out of the first moneys com- ing into his hands as a part or parcel of my estate. Item I give and devise to my beloved wife Edna A. Spivey all of my pro- perty both real and personal, in the counties of Robeson and Collumbus and State of North Carolina, to have and to hold to her the said Edna A. Spivey, for and during the term of her natural life in satisfaction for and in leiu of her dower ??? ????? of and in all my real estate. Item I give and devise to my three sons, Matthew E., J. Marcus and Clyde Spivey jointly, to be divided equally between them, share and share after the death of my wife Edna A. Spivey all of that one hundred and fifty acres that ???? ????? White House Township, Robeson Co adjoining the land of A. L. Hays, L. H. Price Henry Spivey J. M. Sparkman and W. E. Spivey on the S. C. State line and known as the Holmesville place. Item I give and devise to my son J. E. Spivey Jr all of that lot or tract of land in the town of Orrum and in Robeson County, N. C. adjoining the land of W. C. Powell, I. P. Hedgpeth and the same on which myself and family now reside, containing nine and one half acres, more or less. Item I give and devise to my two sons, S. D. and Ira Spivey jointly to be equally divided between them all of that tract of landin Chadborn Town- ship, Columbus County, North Carolina adjoining the lands of C. C. Carter, Fe- lix Carter and others containing one hundred and three acres more or less. Item I give and devise to my five daughters, Daisey A. Spivey, Maud F. Britt, Emma G. Spivey, Hallie K. Spivey, and Corrine B. Spivey, all of my personal of every description to be found at the death of Edna A. Spivey belonging to my estate including all moneys to be equally divided between them,(the above named five daughters) share and share, up to the amount of five hundred dollars each, the residue if any there be, to be divid- ed equally between my six sons, above named. And lastly I do hereby constitute and appoint my beloved wife Edan A. Spivey my lawful executrix to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and claus thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made in witness whereof I the said J. E. Spivey do hereunto set my hand and seal this day of April A. D. 1909 J. E. Spivey (Seal) Signed sealed published and declared by the Said J. E.
