STATE OF NORTH CAROLINA  COURT OF PLEAS & QUARTER SESSIONS
ROCKINGHAM COUNTY               February Term 1849

JAMES B. HILL and TABITHA HILL, his wife

Vs.

CHARLES MOONEY and his wife, NANCY MOONEY; THOMAS MOORE and his wife, POLLY 
MOORE; THOMAS PARKER and his wife, SARAH PARKER;  LATTY SUTTHARD, HENRY 
SUTHARD, ALSEY SUTHARD, BUCKNER SUTHARD whose interest is claimed by RICHARD 
HENDERSON, WILLIAM SUTHARD, WHITFIELD TIPPET and his wife, ELIZABETH TIPPET, 
of full age, and EMILY SUTHARD, PARTHENIA SUTHARD  and HENRY SUTHARD, under 
the age of 21 years.

Petition for Partition of Land

It appearing to the satisfaction of the Court that  the defendants in this 
case, WHITFIELD TIPPET and his wife, ELIZABETH TIPPET, EMILY SUTHARD, 
PARTHENIA SUTHARD  and HENRY SUTHARD reside outside the limits of this State: 
it is therefore ordered by the Court that publication be made for six 
successive weeks in the Patriot, a newspaper printed in Greensboro, that 
unless the said Defendants appear at our next Court to be held in the Court 
House at Wentworth on the 4th Monday in May 1849 , then and there to plead 
answer or demur, judgment final  will be taken pro confesso and heard ex parte 
as to them.
