STATE OF NORTH CAROLINA       SUPERIOR COURT OF LAW
ROCKINGHAM COUNTY       May Term, 1807

PHILIP ROSE

Vs.

JOHN LEAK 

From the return of the Sheriff of this County, it appearing to the 
satisfaction of the Court that FRANCES LEAK, widow of the Defendant in this 
cause, was by Last Will and Testament of the said JOHN LEAK, made the Executor 
and Executrix thereof, and that he, the Sheriff, served on her, a scire facias 
to appear and show cause, if any, she should not be made a party defendant in 
the case, whereof the plaintiff at this present term suggests the death of 
her, the said FRANCES LEAK, Executor aforesaid; it is therefore ordered for 
JAMES BARNETT, Administrator of FRANCES LEAK, deceased to appear at next term 
of this Court to be held for Rockingham County on the 5th Monday after the 4th 
Monday in September next and make himself a party, otherwise the bill will be 
heard ex parte and taken pro confesso.
