Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ FHL Film #0019709 Rockingham Co, NC Register of Deeds Book Q (1815-17) [ I transcribed the surnames in all caps to make them easier to see] Book Q - Pp 423-424 No. 2505 SMITH, John from JOYCE, Robert Deed 184 acres of land This Indenture made this third day of May in the year of our Lord one thousand eight hundred & seventeen, between Robert JOYCE of the county of Rockingham in the state of North Carolina of the one part, and John SMITH of the county & state aforesaid of the other part: Witnesseth, that he the said Robert JOYCE for and in consideration of the sum of fifty pounds current money to him in hand paid by the said John SMITH, the receipt whereof the said Robert JOYCE doth hereby acknowledge & himself therewith fully satisfied, contented & paid, hath granted bargained & sold aliened released & confirmed unto the said John Smith his heirs & assigns forever one certain tract of land containing by estimation one hundred & eighty four acres, situate in the county of Rockingham in the State of North Carolina & on the waters of Sharps Creek, and on the Mayo Mountain - which land, to wit, Beginning on a hickory & black oak in Elisha JOYCE's line, runing thence South one hundred & seventy six poles to a black Jack, thence East one hundred & eighty poles to a white oak on the Bank of the aforesaid Creek, thence North ninety poles to a Spanish oak, thence West sixty four poles to a double Gum, Thence North one hundred & sixty five poles t a black oak, Thence South sixty degrees West To the first Station. Together with all houses orchards gardens fences woods under woods water & water courses thereon Standing growing & being with all other profits commodities advantages & appurtenances to the same belonging or any wise appertaining as also the remainder & remainders reversion & reversions, thereof & of every part & parcel thereof to have & to hold the said tract of land with all & singular the appurtenances to the only proper use & behoof of him the said John SMITH his heirs & assigns forever, & the said Robert JOYCE for himself & his heirs the said land & premises with all & singular the appurtenances unto the said John SMITH his heirs & assigns shall & will warrant & forever defend by these presence against all person or persons whatsoever, having or lawfully claiming any right or title in or to the same, or any part or parcel thereof, & the said Robert JOYCE for himself & his heirs doth grant covenant & agree to & with the said John SMITH his heirs & assigns in manner & form following (viz?) that the said Robert JOYCE at the time of the sealing & delivery of these presence is & stands seized of an indefeaseable estate in fee simple & that he has a good & lawful authority to sell & convey the same in manner & form aforesaid & that the same shall forever remain unto him the said John SMITH his heirs & assigns forever, freely clearly exonerated & discharged of & from all manner of other forms bargains sales titles of dowry & all other rights & estates whatsoever.
