J. Motley from J. C. Soyers & wife Deed This indenture made and entered into between John C. Soyers of the one part and Thos. J. Motley of the other part both of the county of Rockingham and State of North Carolina Witnesseth that whereas the said John C. Soyers and one Jackson Jones now deceased entered into a partnership in said county the year 1853 for the purpose of carrying on the business of Tanning and whereas it was necessary for their purpose to possess such estate and did with the effect of the partnership & for the purpose and business of the partnership purchase a tract or parcel of land hereinafter described upon which is erected a Tannery, and whereas the said real estate and Tannery was [sic] used solely for the partnership, and found and considered by both parties as a part of the partnership assets & liable therefrom to its debts and whereas in year or thereabout of 1859 the said partnership was dissolved and found to be wholly insolvent, and wheras the aforesaid real estate and all the effects of the said partnership were turned over to the said John C. Soyers by the said Jones to clear up and settle the said partnership matters and pay off the debts of the same so far as the proceeds of the said real estate and other assets would go - and the said Soyers was authorized to sell said land for this purpose and whereas the said Jackson Jones therefore did and before the sale of said real estate [word illegible] the said John C. Soyers sole surviving partner of the said partnership and as such authorized by law to [two words illegible] said partnership as well as by the act & [word illegible] of the said Jones in his lifetime & for this purpose to sell said real estate. Now therefore in consideration for the premises together with the further consideration of the sum of five hundred and fifty dollars to him the said John C. Soyers in hand paid by the said Thos. J. Motley the receipt whereof is hereby acknowledged the said John C. Soyers has given granted bargained sold & conveyed and by these presents does give, grant, bargain, sell and convey unto the said Thos. J. Motley and his heirs a certain tract or parcel of land upon which is situated the said Tannery, lying in the County of Rockingham State of North Carolina on the waters of Hogan's Creek, adjoining the now lands of Thos. J. Motley (formerly the lands of said Jackson Jones) and the lands of Miller Nunn and others & bounded as follows ~ Beginning at a Hickory in said Motley's line running the[n]ce East twelve chains (12) and sixt[y] links to a Poplar in Saml Cornwell's line - thence with said line North six chains and ninety-six links to a Sourwood corner with said Cornwell's - thence with his line South 86 degrees East sixty chains & 49 links to a Rock corner Miller Nunn's line thence with said Nunn's line North 28 chains 40 links to a Rock & Pointers corner with said Nunn in Pinkney Chambers' line thence with said line and Chambers North 88 1/2 degrees West 11 chains and 5 links to a Gum & Pointers corner with said Chambers in what is now Thos. J. Motley's line (then Jones) thence with said line South one degree West 28 chains and fifty links to a Black Oak corner with said Motley; thence South 80 degrees West 11 chains to a Rock corner with said Motley's thence 15 degrees East 7 chains 66 links to the first station, containing (44) forty-four acres and four links. It being the land bought & owned by the said Soyers & Jones in partnership set forth by the surviving partner. To have and to hold the above described premises with all the privileges and appurtenances thereunto belonging to him the said Thos. J. Motley his heirs and assigns forever. And Mary J. Soyers wife of the said John C. Soyers for and in consideration of the sum of five dollars to her in hand paid by the said Thos. J. Motley joins her husband in the execution of the Deed of Conveyance and she hereby releases to the said Thos. J. Motley his heirs all her right and interest in the said land either in way of Dowers, Homestead or otherwise, and the said John C. Soyers & wife Mary do for themselves their heirs Executors and administrators covenant with the said Thos. J. Motley & his heirs and assigns forever that they are lawfully seized in fee of the said land that they have right to convey the same & that it is free from any & all incumbrances and that they will and their heirs Executors & administrators shall warrant and defend the right title and possession of & to the said land forever - against the claims & demands of all persons whatsoever.
