JOSEPH MARTIN Judgment By Default In this case, it appearing to the Court that the Defendant is not an inhabitant of this State, and he not having an attorney who appears for him in this Court, not any known attorney in fact: It is, on motion of MR. DUFFY, ordered that depositions of witness de ben esse, may be taken, to be read on the part of the plaintiff, on the trial of this cause. The Plaintiff giving public notice in the newspaper published by MR. BOYLAN in Raleigh, of the time and place, when and where he proposes to take such depositions; which notice shall be published 10 days at least before the time appointed for the examination of such witness. M. STOKES, Clerk By virtue of the above order, I now give public notice that I intend to take the deposition of ROBERT WILLIAMS and others, at the house of GOVERNOR WILLIAMS in Rockingham County, N. C., on the first day of November next, to be read in evidence in the above cause; when and where the said JOSEPH MARTIN will attend to cross examine, if he think proper. WM.
