SARAH ROBERTS – Petition Partition 1818

To the worshipful County Court of Rowan
November term 1818
I Beg have to become one of your petitioners As I am Seventy Seven years of 
age, and by age and Infirmities.  I am past getting my Living by Labour and 
having been the  consort of SAMUEL ROBERTS Deceased, who by his Will Left me 
the possession of his Lands and some other Little property and In addition to 
that, the said SAML ROBERTS Left HARMON LATHEM as copartner with me In said 
possession not Doubting that he wanted treate me kindly, But the Said HARMON 
LATHEM has treated me more Like some Disobedient Savage than Like a Human, Yes 
were I only to make known to your Honours the Ill treatment that I have 
Received from Said Lathem that I known to my Neighbors besided the many 
thousand acts of Ill treatment that I Received privately  It would make you 
Shudder  I now pray that your Honours will view my situation and a Copy of the 
Will, will be presented to you and I hope that yours will order same way 
whereby I may Receive the Little Support allotted me by said Will, as the said 
HARMON LATHEM has turned me out of the House and will not Let me live there, 
nor aid nor assist me In any way, and I hope that If In your powers you will 
Dissolve the partnership and Give me my part or what Is due me by Said ROBERTS 
Will, and In so doing I am your petitioners will as Ever In duty Bounds pray
November the 14th 1818 


Additional Comments:
Samuel Roberts' original will was written April 1799.  He named his wife Sary 
(Sarah) Roberts, his nephew Harmon Latham, and his niece Araminda Kelly.  
Araminda Kelly is Arminta "Minty" Kelly McGuire, wife of Samuel McGuire of 
Rowan County, North Carolina.
