Philip Howard bought 137 acres from Samuel Bryan on Ellsworth Creek adjacent to Benjamin Howard. (Rowan County Deeds, Book 5, p. 364-5) This Indenture made the Fifteenth Day of October in the year of our Lord 1763(?) Between Samuel Bryan of Rowan County in the province of North Carolina of the one part and Philip Howard of the County & Province afsd of the other part. Witnesseth that the sd Samuel Bryan for & in consideration of the sum of Twenty five pounds procl money to him the sd Samuel Bryan in hand paid the Receipt whereof is hereby acknowledged with said Samuel Bryan Hath Granted Bargained Sold Aliened Conveyed & Confirmed and by these presents do Grant Bargain Sell Alien Convey & Confirm unto the sd Philip Howard his Heirs & assigns for Ever half that Messuagae Tenement & plantation Tract or parcel of Land Situate Lying & Being in the County of Rowan afsd Begining at a White Oak standing near the head drafts of Elsworth Creek Runing thence North 240 poles to a post oak thence Et 101(?) poles to a stake Benjamin Howard corner sd Line Thence So 240 poles along Benjamin Howard's Line to a Stake Howard's other Corner 101(?) poles to the Begining Oak Containing One Hundred & Thirty seven acres be the same more or less Being half the Land Conveyed to the said Samuel Bryan by a Deed from Earl Granville Bearing date the 10th Day of May in the year of our Lord 1762 relation being thereunto had may more fully appear with all the Houses our houses Trees woods underwoods Common & Commons of pasture Ways Waters Water Courses profits Commodities Advantages Hereditaments and appurtenances whatsoever unto the sd Messuages Tenement or parcel of Land above mentioned Belonging or in any wise appertaining with the Reversion & Reversions Remainder & Remainders Rents Houses & profits thereof & Every part & parcel thereof Free & Clear of all & from all manner of Incumbrances of any kind whatsoever (the Quitrents becoming Due only Excepted) and all the Estate Right Title Interest Claim & Demand whatsoever of him the sd Samuel Bryan of in the & to the sd premises above ? and Every part & parcel thereof. To have & To Hold the sd Messuages Tenement and plantation above mentioned & all & singular other the premises above mentioned and every parcel thereof with the appurtenances thereof unto the sd Philip Howard his Heirs & assigns and to the only proper use & behoof of him the sd Philip Howard his Heirs & assigns for Ever and the sd Samuel Bryan for himself & his Heirs the sd Messuage Tenement Tract or parcel of Land & every part thereof against him & his Heirs & against all & every other person or persons whatsoever to the sdPhilip Howard his Heirs & assigns shall & will warrant & forever defend by these presents(?) And for the further and better assuring and confirming the sd Title of the above mentioned premises unto the said Philip Howard his Heirs & assigns and the sd Samuel Bryan Doth for himself & his Heirs Covenant promise and agree to & with the sd Philip Howard that upon Reasonable and charges of him the sd Philip Howard shall at any Time or Times Hereafter sign seal & Execute any such Further Instruments Investments in Writing as his or their Council Learned in the Law Shall be Reasonably Devised(?) Advised or Required In Witness whereof The said Samuel Bryan has Hereunto set his Hand and seal the Day & year above Written.
