Between William Ellis of the County of Rowan in the Province of North Carolina and Frances his wife of the one part and Lewis McCartney of the County & province aforesd. Witnesseth that for & in Consideration of the sum of One Hundred & Twenty five pound proclamation money In hand paid by the sd. Lewis McCartney to the said William Ellis & Frances his wife, the Receipt whereof is hereby acknowledged, and themselves therewith fully satisfied have given granted, bargained sold and confirmed and by these presents do give grant Bargain sell and Confirm to the sd. Lewis McCartney his Heirs & Assigns for Ever all that piece or parcel of Land lying & being in the County of Rowan and province of North Carolina aforesaid being part of Henry Eustace McCulloch Esqr’s Tract of Land commonly called or known by the Name of the Tract No. (9) Beginning at a Hickory on the West Line of Henry Eustace McCulloch Esqr his tract No. No. thence 262 poles from his South West corner, running thence No. 200 poles to a Black Oak thence West 262 poles to a stake in the South Boundary line of the Great Tract thence South along sd. Line 200 poles to a Hickory, H. E. McCulloch’s, his corner aforesaid thence East along sd. H. E. McCulloch, his Line 262 poles to the Beginning Containing in the whole Three Hundred & Twenty Acres of Land all which premises are more Particularly Described & set forth in the plan or Map thereof being annexed to a Deed from Henry Eustace McCulloch Esqr. to William Giles: With all Rights & priviledges of Hunting hawking fishing & fowling with all woods Waters & Rivers with all profits Commodities or Hereditiments to the same belonging or appertaining To Have and to hold to him the sd. Lewis McCartney his heirs & assigns for Ever Except that in Case any Mines shall be found upon the sd. Land One Half of all Gold & Silver ore and of all other mines & minerals whatsoever be Reserved for the Use of Henry Eustace McCullooch his Heirs & assigns and the sd. William Ellis and Frances his Wife doth hereby for themselves their heirs Exr.’s, Admr.’s & Assigns Covenant & agree to & with Lewis McCartney his heirs, Executors, Administrators & Assigns that they are the Rightfull and Lawful owners of the sd. Lands and that they have full & ample powers to sell & convey & make over the same forever free from all Incumbrances and by these Doth oblige themselves their heirs Exr.’s and Administrators to Warrant & Defend the same from & against all & all manner of Persons whatsoever Claiming by from or under them or any of them __ whosoever Lawfully Claims or may Claim the sd. Granted premises & that said William Ellis & Frances his wife doth further Covenant & Agree to & with the sd. Lewis McCartney is Heirs & Assigns that he the sd.
