PENDER have instituted a novel suit against the Southern Railway Company for $10,000 damages sustained in the death of M.D. PENDER. The deceased was a painter by trade and a month ago, while returning from his work at Albermarle, to his home in Salisbury, died in the coach in which he was riding. His body was not discovered until after the coach had been placed on a siding on the yards, having reached Salisbury at a late hour at night. The plaintiffs claim that the defendant company should have removed Mr. PENDER from the car when it was apparent that he was dangerously ill. The legal points at issue have never before been submitted to a North Carolian court.
