Berger, Charles - 1793 - Rowan County, NC - Wills Submitted to the USGenWeb Archives by Stephanie Harrison info@conquestmusic.com Will of Charles Berger In the name of God Amen; I, Charles Berger of the county of Rowan and State of North Carolina, being in low state of health by reason of infirmities that is natural in old age but thanks be to God, my Maker, of perfect mind and memory, and calling to mind the uncertainty of human nature, not knowing how soon it may please God to call me out of this world, I do for the better regulation of my worldly affairs and for the peace and tranquility of those whom I shall leave behind me, I think it proper to make and contribute and ordain this to be my last Will and Testament, And in the first place I give and bequeath my soul to God who gave it in the first place and my body to be buried in a christian manner, according to the custom of the country at the discretion of my executors hereafter named, the expense to be by them paid out of my worldly estate. Secondly, I will that all my just debts to be paid and afterward what worldly effects it had pleased God to bestow upon me I give and bequeath in the following manner, viz; In the first place, I give and bequeath to my daughter Elizabeth, sixty pounds, forty-seven pounds of which she has already received, and the balance of it is thirteen pounds, which I do not pay her, or her children in my lifetime, I allow my executors to pay her or her lawful heirs when lawfully demanded. In the second place, I give and bequeath unto my daughter Barbara, sixty pounds, thirty six pounds of which she has already received, twenty-four pounds of which bequeath is yet behind, which sum if I do not pay myself in my life time, I will that my executors pay her or her lawful heirs, when lawfully demanded. In the third place, I give and bequeath to my son Rudolph’s children, he being deceased, which they have already been put in possession of one hundred and sixty pounds, consisting of one hundred and fifty acres of land, lying on Reedy Creek, which land I purchased of George Coons, together with the stock of horses, cattle, sheep, hogs, which I have put them in possession of amounting in full to the whole amount of the aforesaid one hundred and sixty pounds, the land I will that it be equally divided between my two grandsons, Charles and Henry Berger, the stock and other moveable property, to be equally divided between my four grand daughters, Barbara, Yuoluala,Mary and Catherine; And in the fourth place, I give and bequeath to my son George Beryer the mansion house and plantation which I now possess and occupy, consisting of three hundred and twenty three acres of land together with all my moveable property, debts owing to me by others, bonds, book accounts and otherways, and he to pay up all the legacies above mentioned and to perform what is hereafter required in this my last will and testament. In the fifth and last place, I will and bequeath to my dear beloved wife, Johanna, as long as she shall live in this world, my mansion house together with the furniture belonging to it together with what ready cash we shall possess at my decrease and at her decrease to be the property of my son George, he to maintain my dearly beloved wife, Johanna, so long as she shall live, in a decent and gentle manner, with good and sufficient food, raiment, washing and every other thing that may be necessary for a person of her age according to the customs of the christian parto of the country; and for the better execution of this my last will and testament, I do nominate and appoint my well beloved son, George Berger and my well beloved friend, Jacob Wagoner, the whole and sole executors of this my last will and testament, revoking and disannulling all other wills by me heretofore made and do constitute and ordain this to be my last will and testament; in witness I have hereunto subscribed my name and pronounce it to be my last will and testament in the prescence subscribed their names as such.
