February Term 1814 State of North Carolina} Rowan County} In the Name of God Amen I JOHN HAM of the County aforesaid considering the uncertainty of this life and being of Sound mind and perfect memory do make and publish this my last Will and Testament in manner and form following (that is to say) First I give and Bequeath unto my Beloved wife MARY HAM all my personal estate, Goods and Chattels of whatever kind or Nature so ever during her Natural life after a Sufficient quantity of it being Sold to Sattisfy all Just demands that Stands against me, And I give unto my Two Sons namely WILLIAM HAM and JOHN HAM all my Trail of land lying on Hunting Creek, to hold to them their Heirs and assigns forever, and for my said trail of land lying on the East Side of said Creek Joining JAMES McGUIRE and others to be equally divided between my two sons namely WILLIAM HAM and JOHN HAM, and for the division line to run from Said Hunting Creek to the Eastline, and for my son WILLIAM HAM to have the upper part of said land, and my son JOHN HAM to have the lower or Southern part of said lands and for each of their lands to be equal in quantity – And also I do wish and allow my wife MARY HAM to have her Subsistance on said land during her life – And further more my desire is that my orphan boy which I have to raise named CADER CAWLEY to have at his freedom a Hors Saddle and Bridle and for that to come out of my Goods and Chattels, And also I give and Bequeath unto my six daughters namely ELIZABETH, FANUEL, MARY, SARAH, LUCY and EDITH all the remainder of my moovable Estate after the death of my wife MARY HAM, And my desire is that after the death of my wife that all my personall property shall be sold at Public Auction and the money arrising thereby after all just charges being Satisfied to be equally divided among any said daughters namely ELIZABETH, FANUEL, MARY, SARAH, LUCY AND EDITH, only a deduction to take place wherein once has received any thing from me, my desire is that they shall not draw any part until them that has not had any part of my property receives an equal proportion of my estate, and that also my desire is that my son JOHN HAM shall pay to each of my daughters the sum if Five dollars out of his part of the lands And I do hereby appoint my Two Sons (viz.) WILLIAM HAM AND JOHN HAM my Executors of this my last Will and Testament, hereby revoking all former Wills by me made, in Witness Whereof I have hereunto set my Hand and Seal the 12th day of December in the year of our Lord One Thousand, Eight Hundred and Eleven Signed, Sealed and Delivered by the above named JOHN HAM to be his last Will and Testament in the presence of us who have hereunto Subscribed our names as Witnesses in the presence of the Testator Test Wm WILSON JOHN HAM (seal) RICHARD LEACH Additional Comments: John Ham and wife Mary were the parents of Famuel?/Famiel?/Fannie Ham who married David McGuire on August 6, 1810 in Rowan County, N.C. (son of James McGuire, Sr. - mentioned in this will - and Eleanor Luckey). David McGuire and Fannie Ham had four children - James McGuire (husband of Rachel Bailey); Martha "Mattie" McGuire (wife of George D. Blair);George Washington McGuire (husband of Martha Jane Eddins); and Synthia McGuire. David & Fannie McGuire moved to Madison County, Tennessee about 1826. David died about 1839 and Fannie died November 18, 1833 - probably Madison County, Tennesee.
