Joseph McConnaughey - 1787 - Rowan County, NC - Will Submitted for use in the USGenWeb Project Archives by Mollie Matthews Will of Joseph McConnaughey-January 27, 1785 probated 1787, Book E, page 64 In the name of God, Amen. I, Joseph McConnaughey, of the County of Rowan, and the State of North Carolina, Planter, being in a low state of body but of perfect mind and memory, do make and declare this my last Will and Testament, in the manner and form following: First, I give my soul into the hands of Almighty God hopinf for the remission of my sins through the merits of Jesus Christ. My body I commit to the dust in hope of a glorious resurrection and my worldly estate wherewith it has pleased God to bless me I give and devise the following. I give and bequeath to Martha, my beloved wife, one third part of my whole personal estate, my dresser and furniture and her riding saddle. Also I give and devise all that whole message and tenements on which I now live, with all the appurtenences thereto to my sons Joseph and James to be equally divided between them as they themselves may agree on the division. If they can't agree, my will is that each of them chose a man to divide said tenement according to the value and assign to each that respective part which they (i.e. the men chosen) shall think proper, provided my said sons should happen to choose the same part after the division. Also, I give and devise to my two sons Hugh and Sampson all that whole tract of land, late the property of Capt. George Cowan, lying situate, being on a creek by the name of Sills or Second Creek to be equally divided between them as they themselves may agree on that division. The land to be divided acre for acre and not according to the value of the whole tract as above directed in the case of my sons Joseph and James. Also, I bequeath and divise to my son Samuel the sum of twenty pounds or the value thereof in lawful current money of this State, to be paid out of my whole estate after my wife has received her third part as above directed. Also, I give and bequeath to my son Hugh one bay horse known by the name of Little Dick, and to my son Sampson one bay mare called bald face, to be taken out of the whole personal estate before my wife shall recieve her third part as above directed. All the remainder of my personal estate after said legacies of whatever nature or quality the same be and not herein before given and disposed of after payment of debts, legacies and funeral expenses, I do give and bequeath to my sons Joseph and James. Also, I give and bequeath to my daughter Jean Miller the value of one Silver Dollar, to my other daughters, Catherine Swann, Mary Ker (?) vier and Martha Foster, one Silver Dollar each. And I do hereby revoke and disannul all other and former wills and testaments, declaring this and this only to be my last Will and Testament of which my wife Martha, and son Joseph are Executors.
