Submitted by: Lee Marlin Schneider NELinks@aol.com ------------------------------------------------------------------------- Records of wills, Volume c page 492 I, JAMES MARLIN of the County of Rowan, State of North Carolina, Planter, knowing that it is appointed for all men to die, do make, constitute and ordain this my last Will and Testament, in the following manner, Vizt: I will that my body be interred decently at the descretion of my Executors hereafter named, and that all my Just Debts be paid. I give and bequeath to my son DAVID Twenty acres land of a certain tract of land which I hold lying on the South side of the Southfork of the Yadkin River bounding on the River joining my said son DAVID which twenty acres he is to have parallel with the line adjoining his, according as it has been laid off by William Wood, to him and his heirs forever. I give and bequeath to my daughter MARY a certain part of that plantation on which I now live known by Number One. As it was laid off into three lots and represented by John Andrews Sr. I do give her, Lot No. 1 (except a few acres which I will take of it and put to Lot No.3) with all its appertenances also I do give her one cow which she may make choice of to her and her heirs forever. I likewise give and bequeath to my daughter SUSANNA a certain part of my land represented by No. 2 containing eigty-eight acres as maybe seen in the plot, to her and her heirs but not to be sold by her or any other during her natural life, also a note which I have on ELIJAH MARLIN of about forty-five dollars to her and her heirs forever.Part of my land represented by No. 3 also nine acres off No. 1 along the line joining said No. 3 to her and her heirs but not to be sold by her or anyone else during her natural life. Also to receive eighty dollars from my daughter SARAH as will be mentioned hereafter to her and her heirs forever. I also give and bequeath to my daughter SARAH that part of my land which lies on South Yadkin as before mentioned which is not bequeathed to my son DAVID by estimation, eighty acres out of which land my daughter SARAH must pay eighty dollars to my daughter ANNY this said land shall be hers and her heirs but not to be sold by her or any other during her natural life. I also give and bequeath to my grandson JAMES MARLIN and JAMES M REPULT each of them ten dollars at my decease. Also I will that all my property that hath not been bequeathed be put to sale and the monies when collected and that in hand be equally divided among my five children , vizt: DAVID, MARY, SUSANNAH, ANNY, and SARAH, to them and their heirs forever. I do make, constitute, ordain and appoint DAVID MARLIN and William Gray sole and whole Executors of this my Last Will and Testament, utterly disannulling and revoking all other wills and bequeathments by me heretofore thus name other to be my Last Will and Testament in Witnesses whereof I have hereunto set my hand and seals this 27day of December in the year of our Lord one thousand eight hundred and fifteen.
