Town No. Eight North. Range No. Eleven West. Also the South East quarter of the South East quarter of Section No. Two and the North part of the West half of the North East quarter and the North part of the East half of the North West quarter of Section No. Twelve all being in Township No. Eight North Range No. (11) Eleven of the 3° P.M. Also the North East quarter of the North East quarter of the section No. Thirty Six in Township No. Nine North Range No. Eleven West of the 3° P.M. Provided (and the bequest is upon these conditions) that the said Elvin Armstrong continues during the remainder of my natural life to take as good care of me as he has herefore done - and to bring no charges against my estate - and at my death defray the cost and charges arising from my internment, and pay or cause to be paid within one year from my decease to my executor the sum of three thousand dollars ($3,000) lawful money of the United States. 2nd I give and bequeath to my friend Mary Ann Armstrong the sum of One thousand dollars. 3rd. I give and bequeath to my nephew Timothy McGuire (now residing in North Carolina)the sum of Five hundred dollars. 4th I give and bequeath to my niece Mary eldest daughter of my sister Nelly Turner (also residing in the state of North Carolina) the sum of Five hundred dollars. 5th After the payment of my just debts and the costs and charges of settling my estate I give and bequeath to my nephew James McGuire, M.D. all the residue of my estate. I hereby nominate and appoint my friend John P. Stout executor of this my will. In testimony whereof I have hereunto subscribed my mark this second day of September A. D. 1875. Stout Executor of the Estate of James McGuire, Deceased State of Illinois Jersey County Additional Comments: James McGuire, Jr. was the son of James McGuire, Sr. and Eleanor Luckey. James and Eleanor McGuire’s other children were: Eleanor “Nelly” McGuire Turner (married Alexander Turner); David McGuire (married Fannie Hamm); Samuel McGuire (married Arminta/Minty Kelley); Thomas McGuire (never married); Sarah “Sally” McGuire (never married - mother of Dr. James McGuire); and Mary “Polly” McGuire (never married). James McGuire, Jr.’s biography, placed in the 1872 Atlas of Jersey County, Illinois by Andreas, Lyter & Co., Davenport, IA, states James McGuire, Jr. was born in Rowan County, North Carolina on November 4, 1794. It states he was the sixth child of seven children born to James McGuire, Sr. and Eleanor Luckey (both natives of Lancaster, Pennsylvania). James, Jr. left his native state in 1829 for St. Charles County, Missouri. In 1832, he enlisted in Captain Nathan Boone’s (son of Daniel Boone) company of rangers. On April 1, 1833, when his service was over, he returned to St. Charles County, Missouri and stayed until November 1833. He then came over and settled in what is now Jersey County, Illinois. According to his biography, he was very poor when he arrived in Jersey County, IL. He purchased land at government prices, and carved out a comfortable home out of the rough wilds. James McGuire, Jr. stated that from early boyhood, he had always been a supporter of the principles of the democratic party. He was a great admirer of Andrew Jackson and his policy. At the time of his biography, he had been residing at his residence, enjoying good health. James McGuire, Jr. never married. In his Last Will and Testament, James named three family members: nephew Timothy McGuire (son of Samuel McGuire - b. 1820; d. between 1875-1878); niece Mary “Polly” Turner Seaford (daughter of Eleanor/Nelly McGuire Turner - b. 1822; d. 1887); and nephew James McGuire, M.D. (son of Sarah/Sally McGuire - b. 1829; d. 1909). All three were born in Davie County, NC (formally Rowan County, NC) and all three died in present day Davie County, North Carolina. James McGuire, Jr. died on April 20, 1877 in Jersey County, IL and is buried in the Keller Cemetery in Jersey Township, Jersey County, IL.
