POOL - NOV. 1832 03/18/2001 Will Book H/559 - photocopy from Rowan History Room I, John Pool, of the State of North Carolina and County of Rowan, being of a sound and disposing mind and memory, but weak and feeble of body, and calling to mind that it is appointed for all men once to die; and being also admonished from my age, that I too must soon go the way of all the living, do make and order in this to be my last Will and Testament, in the manner following, to wit. I leave my body to be buried and my soul to Christ. And as touching what worldly substance it has pleased God to bless me with, I dispose of it in the following manner, to wit: 1st - I give to my beloved wife ELIZABETH POOL, my plantation, with eight negroes of her own choice, together with one waggon and giers, five horses and two colts, and all the farming implements: these things she is to have during her natural life, on condition she remains my widow, or as long as she does remain so; But should she marry, then she gets only five hundred dollars, one horse of her own choice and saddle & bridle; and one bed and furniture. At present to have all the grain on the plantation, except one hundred and fifty bushels of wheat, which I wish to be sold. 2nd - I give and bequeath to my daughter ELIZABETH BROWN, one hundred dollars, which together with nine hundred dollars already given to her, will make one thousand dollars. 3rd - I give and bequeath to my son DAVID POOL, three hundred dollars, which together with seven hundred heretofore given him, makes one thousand dollars. 4th - I give and bequeath of my daughter MARGARET POOL, one thousand dollars. 5th - I give and bequeath to my son JOSEPH POOL, one thousand dollars. 6th - I give and bequeath to my daughter MARIA POOL, eleven hundred dollars. 7th - I give and bequeath to my daughter ELIZA POOL, Twelve hundred dollars. 8th - I give and bequeath to my daughter REBECCA POOL, thirteen hundred dollars. 9th - It is also my will that my two sons, DAVID & JOSEPH, take my plantation, and pay the other children three hundred dollars, to be equally divided between them, if they are disposed to do so. 10th- It is my will that my wife keep and raise on the plantation all my small negroes, until they are able to do something, or otherwise disposed of. 11th- It is my will that my children get the above legacies as they severally become of age, either in money or negroes, as may best suit the situation of my estate. 12th- I leave to my wife, all the stock of every description, all the household and kitchen furniture, and all the crop on hand and now growing on the plantation, with the exception of the wheat above mentioned; with the exception also of six head of horses, and one waggon, to be sold. If, however, my wife marries, then the property mentioned in the above clause, reverts back to my estate, as in the first item. 13th- It is my will and express order, that all my just debts be paid, and that out of the first monies that may be on hand. 14th- I appoint my son DAVID POOL, & my friend JOHN HAMPTON to be my Executors to this my last Will & Testament. The above I declare to be my last Will and Testament; hereby revoking all and every other Will or Wills heretofore by me made. Witness my hand & seal this 9th day of October A.D. 1832. HORAH MICHAEL BROWN CODICIL - 15th October 1832 The following Codicil, or alteration, made the 15th October 1832, to wit: It is my Will, that the crop of cotton now growing on my plantation, be sold by my Executors when it is gathered or picked out of the field, on a credit of twelve months, to assist them in paying off my debts; and not given to my wife, as mentioned in the 12th item above.
