I SAMUEL ROBERTS of the County of Rowan and the State of N. Carolina being in perfect health of body & sound in mind & memory, thanks be to God therefor; and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will & testament. That is to say imprimis I give & recomend my soul into the hand of almighty God who gave it me, & my body to the earth to be decently buried at the direction of my executors; nothing doubting but all the general resurrection, I shall receive the same again, by the mighty power of God, and as touching such worldly estate where with it had pleased God to bless me with. I do dispose of in the manner & form following. I give bequeath unto my beloved wife SARY ROBERTS a free and full possession of all my estate both real & personal during her natural life or widowhood but if she should marry, therefore be dispossessed of all & every part thereof, except what the law will allow her. I do appoint & ordain that my beloveth nephew HARMON LATHAM be a copartner with my wife in the possession of this my estate & at her death or marriage of my wife the whole of this my estate to decent to him except what is hereunter mentioned. That is to say I give & bequeath unto my beloved niece ARAMINDA KELLY one cow & a feather bed with the furniture at her marriage day or when she arives to the age of twenty one years. I do appoint & ordain that my beloved wife SARY ROBERTS and my nephew HARMAN LATHAM be the sole executor of this my last will & test. I do hereby utterly disallow, revoke & disannul, all & every other form test., wills, Legacies, bequeathes, & executors by me & any wise before made willed, or bequeathed, ratifying & confirming, this to be my last will & testament, in witness whereof I have here unto set my hand & affixed my seal this 17th of April in the year of our Lord 1799, signed, sealed, pronounced & declared by the said SAMUEL ROBERTS in presence of us. Elijah Renshaw Sam Robert(Seal) Sarah Renshaw Additional Comments: Samuel Roberts’ niece Araminda Kelly mentioned in the above will is Arminta “Minty” Kelly wife of Samuel McGuire. “Minty” Kelly married Samuel McGuire, son of James McGuire, Sr. and Eleanor Luckey, on June 3, 1815 in Rowan County, North Carolina – Bondsman was Christopher Keller and Witness was R. Powell. Minty Kelly was born in Maryland about 1795 and died before 1870 in Davie County, North Carolina. It is unknown who Minty’s parents were but it assumed her mother was a “Roberts”. Samuel & Minty McGuire were the original owners of the McGuire-Setzer House located in Mocksville, Davie County, NC. The McGuire-Setzer House is listed with the National Register of Historic Places of North Carolina. The above Samuel Roberts has been identified as the Samuel Roberts in Surry County, NC who purchased land from Samuel Doyel on August 14, 1797.
