RUTHERFORD COUNTY, NC - DEEDS - David A. Thompson, George Van Nest and William Redmond to John Hill, 1 Mar 1902 ----¤¤¤---- This Indenture, made this first day of March in the year of our Lord, one thousand nine hundred and two between DAVID A. THOMPSON of the City and County of Albany, and State of New York, and GEORGE VAN NEST AND WILLIAM REDMOND CROSS of the City, County and State of New York, parties of the first part and John Hill of Rutherford County, State of North Carolina, party of the second part Witnesseth, that whereas ISAAAC BRONSON and GOOLD HOYT, now deceased, late of the said City of New York, conveyed to JAMES J. HOYT, WILLIAM G. WARD AND JOHN WARD, ALL OF THE SAID CITY AS Trustees, by a Deed of Trust, made and executed on the eighth day of March, one thousand eight hundred and thirty, and Registered in Book 37, Number 400, in the Register’s Office of Rutherford County, in said State of North Carolina, all their lands in the said State of North Carolina: And Whereas, the said John Ward, survivor of the said James J. Hoyt, William G. Ward, and John Ward in pursuance of the provisons of said Deed of Trust, by Deed made and exectuted in the said City of New York, on the eighteenth day of February, one thousand eight hundred and fifty-nine, conveyed all of said lands then reamining unsold, to William Redmond, Junior, Isaac Bronson and Francis Randall, upon like trusts, and to like uses, as those of the said conveyance from the said Isacc Bronson and Goold Hoyt, to the said James J. Hoyt, William G. Ward, and John Ward. And whereas, the said William Redmond, Junior, Isacc Bronson, and Francis Randall in pursuance of the provisions of said last executed Deed of Trust, by Deed made in the said City of New York, and dated the fourteenth day of November, one thousand eight hundred and seventy-one, conveyed all of said lands then remaining unsold to William Redmond, Junior, Isaac Bronson and Francis M. Scott, upon like trusts, and to like uses as to those of said conveyance to William Redmond, Junior, Isaac Bronson, and Francis Randall. And Whereas, the said last mentioned Isaac Bronson departed this life on the 28th day of March 1872. And whereas, the said William Redmond, Junior, departed this life on or about the 6th day of December, 1898. And Whereas, the said Francis M. Scott, as surviving trustee in pursuance of the provisions of said last executed Deed of Trust, by Deed made in the said City of New York, and dated the twelfth day of March, one thousand nine hundred and one, conveyed all of said lands, then remaining unsold, to David A. Thompson, George Willett Van Nest and William Redmond Cross upon like trusts and to like uses as those said conveyance to William Redmond, Junior, Isaac Bronson, and Francis M. Scott. Now, therefore, in pursuance of the said Deeds of Trust, and in consideration of Forty-eight and 42/100 ($48.42) Dollars, lawful money of the United States of America, received by the agent of the heirs and assigns of the said Isaac Bronson and Goold Hoyt, in the State of North Carolina, and for their use, and on the approval of Willet Bronson, Superintending Agent, endorsed heron, we, the said David A. Thompson, George Willett Van Nest, and William Redmond Cross, trustees, as aforesaid, have bargained, sold, released and confirmed, and by these presents do hereby bargain, sell, release and cofirm unto the said John Hill all the certain piece or parcel of land, situate in the County of Rutherford in the State of North Carolina bounded and described as follows, to wit: All those 24 acres of land, part of Patent No. 1039, on the waters of Mountain Creek, bounded as follows: Beginning on the stone, H. Melton’s corner on the South side of the Cove Road, and runs South 58 West 34 poles to a White Oak on his line; then South 4 West 33 poles to a stake on H. White’s line; then with it East 572/5 poles to a Pine, his corner; then with M. (N?) L. Blands’ line North 50 East 42 poles to a broken down Pine, his corner, on the West side of the Cove Road; then with it North 37 Est 13 poles to a stake in the road; then North 37 East 8 poles to a stake; then North 661/4 West 58 poles to a red Oak; then South 4 West 11 poles to the beginning. Together with all the rights, privileges and appurtenances therunto belonging, or in anywise appertaining; excepting and reserving, however, all mines, ores and minerals theron, with the right to enter on said lands to search for and work the same, and to have such possession and occupancy, ingress and egress as shall be necessary for working said mines, and collecting, smetling and refining such ores and minerals, with a little injury to the occupant thereof as may be consistent with the advantageous management of said business. To have and to hold said lands and premises with the appurtenances to the said John Hill, his_______(blank) heirs and assigns forever (except as above excepted). Thompson, George Willett Van Nest, and William Redmond Cross, known to me, who severally acknowledged the execution of the foregoing deed of conveyance, for the purpose therin expressed, as their act and deed.
