I James Dickey of Rutherford county in the State of North Carolina in the Eightieth year of My age Being Weak and Low in Body Yet Considering myself Sound enough in Mind and Memory to Make my will Thanks be given to God therefor And Calling to Mind the Mortality of my Body knowning that it is appointed for all Men to Die and after that to come to Judgement & Remembering the Uncertainty of all earthly enjoyments Do make and ordain this to be my last Will & Testament. First Recommending my Soul into the Hands of allmighty God who gave it me & Do allow my Body to be Restored to its Original & Mother Earth in a decent & Christian Manner at the Discression of My Executor Nothing doubting but I shall Receive the Same again at the general Resurrection by the Mightly Power of God and as touching Such Worldly estates where with it hath pleased God to Bless me in this Life I give Devise and dispose of the same in the following Manner & form In the first place allowing all my Just Debts and funeral Charges to be paid and as it is uncertain how Long it may please God to Continue me in This world likewise what May Remain of My Estate at My Decease I would be the More particular. I Do allow and it is my will that me Dear Wife Mary have her Sidesaddle and all my House furniture, the Eldest gray horse & third of the Cattle to be her own and at her Disposal if she survives. I also give and Bequeath to William Barr My Grandson My young grey Horse and a young Cow that is known by being called his. All the Remaining Part that Should be at my Decease I Do allow to be Sold after My Decease, Whether goods & Chattels or Lands & Tenements the time and Manner of which Sale I do leave to the Discression of my Executor & If any Lands should be Disposed of by Virtue of this my Last wish I Do hereby authorise My Executor & impower him to Make sufficient Deed or Deeds to the same to the Purchaser of If he my said Executor Should agree to & with the other Legatees to pay their Equal parts of the Value of Such Lands then by this My last Will & Testament I Do allow the Right to Remain in him and I Do hereby allow after all is Sold an Equal Division to be made Between my Beloved Children that is to say Isabel Ferguson, Anthony Dickey, Margaret Hughes, Martha Dickey My Daughter in law & David Dickey My Son whom I appoint whole & sole Executor of this My Last will & Testament & I Do hereby Revolk and Disavow all former Wills Bequeaths & Executors Before by me Named or Made Rating this and NO other to be my Last will & Testament.
