Second: I will and bequeath to my daughter Barcelona Gray the sum of one dollar ($100) to be paid her by my other children when she comes for it. Third: I will and bequeath to my dau- ghter Lizzie Lovelace all my household and kitche furniture and all personal property of what ever kind I may have at my death. Fourth: I will and bequeath to my said daughter Lizzie Lovelace the home place that is the dwelling house and all of the land lying on the same side of the road with said dwelling house, to her and the heirs of her body, and in the event she dies without children then the property to go to her nearest of kin as provided by law. The land I will to Lizzie Lovelace is on the west side of the Piney Mountain road and the land I will to Sabe Jane is on the east side of said road and known as the saw mill field or tract. C. Erwin M. S. Ware [Transcriber's note: on 20 Aug 1921, D. B. Johnston, Clerk of Superior Court in Rutherford Co., N. C. deposed one L. G. Ware, who stated "that he is well acquainted with the hand writing of M. S. Ware, having often seen him write, and that the signature of the said M. S. Ware affixed to the annexed paperwriting <> is his own proper hand writing." He further stated that "M. S. Ware is a non-resident of the state of North Carolina." On the same day, D. B. Johnston met with Lizzie Lovelace and O. C. Erwin for the probate of the will, signed by Johnston and Erwin.
