Sutton Petition to sell personal property for division Recorded in Special Proceedings Book 4, page 37 25 Nov 1893 State of North Carolina, County of Sampson In Superior Court The Plaintiff Petitioners respectfully petitions the court as follows: That S. R. Daughtry late of said county and W. T. Sutton were the joint owners as tenents in common of the following personal property located in county consisting of one Steam Engine 15 horse power, Cotton Gin, Cotton Press, Gin House and fixtures of all kinds. That said S. R. Daughtry died in Sept 1893 and the plaintiff petitions as his duly qualified Exe'r is the owner of an undivided one half interest in said property, and the defendant is the owner of the others. That an account of the character of said property the same cannot be actually divided without serious loss and damages and injury to the respective rights and interests of the owners thereof. Wherefore your petitioners prays that a sale of all said property may be made under an order of this court upon such terms as to the the court may seem just and proper and for costs. Henry E. Sutton Order of Sale This cause coming to be heard upon the petition herein and at opinion to the court that summonses has been duly served and the defendant failing to appear and answer: and it further appearing that a sale of the steam mill, gin, gin house and press is necessary for a division. It is therefore ordered and adjudged and decreed that the said property be sold on the premises and for the purpose of revoking said sale, S. W. Sutton is appointed a commissioner of this court who after due advertisement shall make said sale and make his report to this court without delay. Terms of sale twenty five per cent cash and balance in --- equal payments in six and twelve months with 6 per cent interest from date. Title reserved and this cause is ordered Dec. 13, 1843. J. S. M. Sutton, respectfully reports to the court that under the order of sale heretofore made in this cause be proceeded, after due legal advertisement according to the order of said court, on the premises, on Thursday, Jan'y 4th, 1894, when and where Jas. B. Daughtry became the last and highest bidder of the price of $300 and duly complied with the terms of said sale by paying the percent and giving his notes for the balance due. That said sale was open and fair in all respects in the presence of the parties intended and he recommends the confirmation of the same. S. W.
