Trans: 30 pounds specia for 100 acres “On the North side of the seven mile Swamp Beginning at…Willis Gibbs corner.” Deed mentions a pond. Land was “granted By letters patent Bearing date (19 December 1794) to the said Luke Smith.” Wit: Abraham Naylor and Joab Blackman. (1n,2,4,8j) Page 415. Deed: Bartholomew Gainey (a “labourer”) to Noel Gainey. Dated 22 August 1797. Trans: 150 pounds for 150 acres being “One Certain tract… of land and part of Two other tracts…the whole tracts… lying.. On the West side of Great Cohara.” The first tract began “by the side of the swamp By John Stouts Corner as then Was Running thence along Stouts line,” etc. Deed mentions “Jumping Run (struck out) Branch.” “the side of the branch by the great Road,” and Coharie Swamp. Land was “granted to Bartholomew Gainey letters Patent Bearing Date” 21 April 1764. Deed States: “the Other two parts of tracts of land Joining the above land the former and the two latter parts of tracts including all the land I Now possess On the West side of the Run of great Cohara.” Wit: Joab Blackman and Willis Lee. DEED: …from Joab Blackman to Abram Gainey and Elias Gainey for 200 acres in two tracts was acknowledged … 11 Feb 1800 [date from Jerome Tew] 12 May 1800 OVERSEERS: …Ordered that Noel Gainey be overseer of the road in the room of David Grantham and Bennit Hill, and that David Grantham and the usual hands that worked under him and the usual hands that worked under Bennit Hill, except Francis Hill’s hands and also Moses Westbrook, work under him. Also ordered that Noel Gainey be overseer and the hands under him work on the road from the fork near Warwick’s as the old road leads to the corner of Peter Lee, Jr.’s fence. Thence his new opened way along his fence into the old road. Thence to the corner of Noel Gainey’s fence and along the side of his fence the new opened way into the old road. Thence along the side of his fence the new opened way into the old road near Gainey’s Race Paths. Thence the old road to the corner of Joab Blackman’s fence. Thence along the side of his fence the new opened way and past the corner into the old road. Thence along the old road to the fork at or near the county line (Editor’s Note: This road lay in northeast Sampson near present-day Newton Grove.) The worshipful William Kirby, James Jackson, John Ingram, Ben Phillips, David Kornegay, Gabriel Holmes, Bennett Hill and Michael Sampson, Esquires, present. GAINEY ESTATE: Sylvannah Gainey came into court and prayed administration of her dec’d husband’s estate. She posted bond of 300 pounds. Her security as John Jackson. Ordered that Ben Philips, Abraham Naylor, John McCondikee and Cato Lee be a committee to lay off and set apart 12 month’s provisions for Sylvannah Gainey, widow of Noel Gainey, dec’d. Ordered that Sylvannah Gainey have leave to sell the perishable property of the said deceased. At a later court – [I did not get date –jcd] GAINEY ESTATE: John Jackson returned an account of sales of the estate of Noel Gainey, dec’d, and also a report of 12 month’s provisions for Sylvannah Gainey, widow of the said dec’d. 8 August 1808, Monday GAINEY GUARDIAN: John Jackson came into court and was appointed guardian to two minor children of Noel Gainey, dec’d, by the name of Royal and Josiah Gainey. He posted bond of 250 pounds. His security was Phillip Tew. GAINEY ESTATE: Ordered that the sheriff summon a jury to lay off Silvannah Gainey’s dower of land, the widow of Noel Gainey, dec’d. At the next court: GAINEY ESTATE: Ordered that the order of the last court be continued to settle and divide the estate of Noel Gainey, dec’d. 15 November 1809, Wednesday GAINEY ESTATE: Ordered Abraham Naylor, John Fleming and John McKenzie be a committee to divide the estate of Noel Gainey, dec’d, with Silvanah Gainey as administrator to said estate and report to next court.
