Large file in NC Archives file number 87.508.38. -------------------- N C Archives - Sampson County Special Proceedings Written: 1876 Petition to sell land for assets Superior Court: Sampson County Blackman Lee Administrator of Pharaoh Lee deceased Plaintiff Against Heirs of Curtis Lee Heirs of Edmund Lee to wit Matilda and Ursula Lee Heirs of Ann Hudson wife of William Hudson Heirs of Leanna wife of Hardy Lee Heirs of Aley Lee wife of Joab Lee to wit Westbrook Lee and Elizabeth Johnson Heirs at law of said Pharaoh Lee To the Clerk of the Superior Court for said County: The Petition of Blackman Lee Administrator of Pharaoh deceased respectfully showeth that he was appointed Administrator of said intestate by the Judge of Probate of said county on the 17th day of May 1875. Outstanding debts amount to about five hundred dollars. Value of personal estate about two hundred dollars the proceeds of which have been applied to debts, funeral and testementary expenses. Intestate was seized of the following lands, a tract of land originally several tracts about eight hundred acres of which was devised by the last will of said Pharaoh Lee and about one hundred and twenty five acres were not so disposed of and as to which one hundred and twenty five acres he died intestate of the value of about four per acre, and that the said lands descended to his heirs at law to wit: the children of Curtis Lee deceased; the heirs Edmond Lee to wit Maltilda and Ursulla Lee; the heirs of Ann Hudson wife of William Hudson; the heirs of Leanna Lee wife of Hardy Lee; the heirs of Aley Lee wife of Joab Lee to wit Westbrook Lee and Elizabeth Johnson; the above being the heirs at law of said Pharoah Lee. ---------- State of North Carolina 26 Jan 1876 To the Sheriff of Sampson County Greeting You are hereby commanded to summon the defendants Boyett Lee, Gardner Lee, Calvin Lee, John Lee, Fox Lee, George Lee, Henry Lee to appear at the office of the Clerk of the Superior Court 20 days after the summons. Clerk of the Superior Court Sampson County in the Superior Court 26 Jan 1876 Blackman Lee Administrator Against Boyett Lee, Gardner Lee, Calvin Lee, John Lee, Fox Lee about 15 years of age, George Lee and Henry Lee about 12 years of age. The Petition of the plaintiff sheweth unto the court that Pharaoh Lee late of said county died sometime in the year 1871 and made a last will and testament desiring to the defendants Boyett Lee, Gardner Lee and Calvin Lee Colored men two hundred acres of land each and to the defendants John Lee, Fox Lee, George Lee and Henry Lee fifty acres each and left about one hundred and twenty five acres undisposed of by said will, that he left nine hundred and twenty five acres adjoining the lands of William Daughty, Gainey West and others eight hundred of which was disposed of by his will and one hundred and twenty were undisposed of and descended to the heirs at law of the said Pharaoh Lee. That the said Pharaoh Lee left no Executor and the plaintiffs Blackman Lee has been appointed administrator. The plaintiff further alleges that a sale of the land undevised will be necessary to make assets to pay debts and that it will be necessary to have the interests of the said devises declared and set apart. The plaintiff therefore prays for an order appointing five commissioners to review the said land and by the assistance of a surveyor to make a division of the said land ascending to the heirs of said will and to report their proceedings to this court. Culbreth CC ---------- Newspaper clipping 26 Jan 1876 Notice State of North Carolina in the Probate Court Blackman Lee, Adm'r of Pharaoh Lee dec'd vs Heirs of Curtis Lee; heirs Ed Lee; heirs of Ann Hudson wife of William Hudson; heirs of Leanna Lee wife of Hardie Lee; heirs of Aley Lee wife of Joab Lee It appearing to the satisfaction of this court that the ordinary process of law by summons cannot be served upon the above named defendants, they being non-residents of the State, or their place of residence are unknown. It is ordered that publication be made for six weeks in the Duplin Record, a newspaper published in the town of Magnolia, giving notice to said defendants that a petition has been filed in this office for the sale of the lands of Pharaoh Lee, deceased, in order to constitute assets in the hands of the administrator. The defendants are hereby notified to appear within twenty days from the date of this publication and show cause why said petition should not be granted and let them take notice that if they do not appear within that time and answer the complaint of the petitioners an order will be issued in accordance with the prayer of the petitioner.
