Sampson County, NC - Love A. Tatom to Henry A. Bizzell, 1856 ~~~~~~~~~~ This Indenture made this the 8th day of March one thousand eight hundred and fifty six between Love A. Tatom of the County of Sampson and State of North Carolina of the one part and Henry A. Bizzell of the same State and County of the other part. Witnesseth that the said Love A. Tatom being desirous to secure to David Carroll & Mary B. Carroll his son in law & daughter the property herein contained for the natural love & affection which he has & bears towards them & for the further consideration of the sum of one dollar to him in hand paid by the said Henry A. Bizzell before the signing of these presents, the receipt whereof is hereby acknowledged hath given granted bargained & sold unto the said Henry A. Bizzell & to his heirs executors administrators and assigns the following negroes Viz. Harriet, black, aged about seventeen years; Flora, black, aged about fourteen years; Jenny, light black, aged about thirteen; Jane, black, aged about seven. To have & to hold to him the said Henry A. Bizzel & his heirs executors administrators and assigns. Never the less in special trust and confidence for joint use of David Carroll & wife Mary B. Carroll during their life or lives & to the use of the services or of them & after their death to the only use & behoof of such child or children of the said David Carroll & wife Mary B. Carroll as may be then living and if at any time the said David Carroll & wife Mary B. Carroll shall become dissatisfied with my said negroes above named or either of them surviving the other should be so dissatisfied then under this power hereby conveyed the trustee shall sell the same & invest the money according to the direction of them if living & of the survivor of them & such money so invested & whatever is purchased with said money arising from said sale shall be held by the said trustee Henry A. Bizzell in the same manner & for the same purpose as said negroes are held in and that said Love A. Tatom before the signing sealing & delivery this deed doth except the life estate of his wife Rebecca Tatom in the above named slave Harriet & then after her heath the said trustee to hold said above Harriet for the purposes herein set forth and the said Love A. Tatom doth convenant to and with the said Henry A. Bizzell that he will forever warrant and defend to him trustee as aforesaid the right and title of the above named slaves Harriet, Flora, Jane & Jenny and all their increase to him & his heirs forever free from the claim or claims of all persons whatsoever & that he the said Love A. Tatom will at any time when the said trustee shall be advised by counsel learned in the law that it may be necessary execute any further title to said slaves as shall be required to assure a good title to them.
