HUGGINS This indenture made this August 30th A. D. 1876 between Tillinghast H. Merritt and wife Caroline M. party of the first part, and James J. Huggins of the second part and all of Sampson County and State of North Carolina, Witnesseth that for and in consideration of the sum of One Hundred dollars the receipt whereof is hereby acknowledged, the said party of the first part hath bargained sold conveyed and granted, and by these presents doth bargain, sell, convey and grant, unto the party of the second part, his heirs and assigns in fee simple, a certain parcel or tract of land lying and being in Piney Grove Township, Sampson County, North Carolina, adjoining the lands known as the Harriet Williams lands now occupied by H. S. King, the lands of W. B. Darden, W. R. Sutton, J. J. Huggins, the Reddick Darden land and others, the said tract of land being known as the lands bequeathed by Richard Jordan deceased to Mary S. Jordan containing by estimation Ninety Six acres more or less. To have and to hold all and singular the said premises, together with all the appurtenances thereunto belonging the said party of the first part for themselves their heirs and assigns agree and covenant with the said party of the second part his heirs and assigns forever to defend the right and title thereof against the lawful claim or claims of any and all persons whatsoever. In witness hereunto set their hands and seals, date above written. The words "Mary S. Jordan" were interlined in the fourth line from the bottom on 1st page before the assigning this paper writing. Huggins was this the 5th day of September AD 1876 duly proven before the undersigned Judge of Probate for said County by the oath and examination of Oscar H. Huggins has produced a deed of conveyance made to him from Tillinghast H. Merritt and Caroline M. Merritt his wife of a certain tract or parcel of land lying and being in the County of Sampson in said State and procured the execution of the same to be proven as to the said Tillinghast H. Merritt before me D. A. Culbreth, Judge of Probate for said County, and it being represented to our said Court that it is required by Law that Caroline M. Merritt wife of the said Tillinghast H. Merritt be examined privily as to her free consent in executing the said conveyance: Know ye That reposing confidence in your prudence, I have appointed you and by these presents do give you full power and authority to take private examination of the said Caroline M. Merritt wife of the said Tillinghast H. Merritt concerning her free consent in executing the said conveyance and I therefore command you that at such certain day and place as you shall think fit you go to the said Caroline M. Merritt if she cannot conveniently come to you, and privily and apart from her said husband, examine her whether she executed the said conveyance freely and of her own accord, and without fear or compulsion from her said husband, and when you have taken the examination, you are to send the same closed under your seal, together with this commission, to our said Court of Probate. Clifton Justice of the Peace of Sampson County Caroline M. Merritt wife of Tillinghast H. Merritt and acknowledged the due execution of the foregoing deed of conveyance, and the said Caroline M. Merritt being by me privily examined separate and apart from her said husband touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion from her said husband, or any other person, and that she doth still voluntarily assent thereto.
