All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Donna Newman centavo@lserv.com October 16, 2011, 6:04 pm Written: September 19, 1780 Recorded: September 29, 1783 Duplin-Sampson County Deed Book 4, pp 252-254 (Transcribed as written, the best I could interpret some of the faded writing) Edward Jackson to Gabriel Holmes This indenture made this 19th day of September and in the Year of Our Lord One Thousand seven hundred and eighty 1780 and in the fifth year of American independency Between Edward Jackson of the province of North Carolina and County of Duplin Planter of the One part and Gabriel Holmes of the County and province aforesaid Planter of the other part Witnesseth that the said Edwar[d] Jackson for and in consideration of the sum of Five hundred and Fifty pounds 550 pounds Current money of the aforesaid province paid by the aforesaid Gabriel Holmes the Receipt whereof I the said Edward Jackson do hereby acknowledge and myself therewith fully Satisfied Contented and paid thereof and every parcel thereof do acquit Exonerate and discharge the said Gabriel Holmes his heirs Executors administrators and assigns forever and by these presents I have given granted Bargained and sold aliened conveyed and confirmed and by these presents I do freely fully and absolutely give bargain sell alien Convey and confirm unto the said Gabriel Holmes his heirs Executors administrators and assigns forever One Certain Messuage or tract of land containing by Estimation Three Hundred and twenty 320 acres of land be the same more or less lying and Being in the County of Duplin on the west side of great Coheary Beginning at a pine John Magee’s Corner thence as his line East 600(?) poles to a pine by a marsh James Green’s Corner and Simon Herring[‘s] old corner thence as Green’s line to his corner and past(?) South two hundred poles to a gum Sapling thence west 150 poles to a pine sapling said Green’s Corner at(?) and other survey thence as it(?) west 124 poles to a white Oak his corner thence South 30 poles to the run of the Beaverdam thence up said Run to (?) Edward Newman’s Corner a gum thence along said Edward Newman’s line to the First Station(?) the aforesaid tract of land granted to Edward Jackson by patent bearing Date the first day of April and in the fourth year of our independence and in the year of Our Lord One Thousand seven hundred and Eighty 1780 and conveyed from the said Edward Jackson to the aforesaid Gabriel Holmes to Have and to Hold the said granted and bargained premises with all the appurtenances privileges and commodities to the same belonging or in any wise appertaining to the said Gabriel Holmes his heirs Executors administrators or assigns forever to his and their only proper use benefit and behoof forever and I the said Edward Jackson for my heirs Executors administrators do covenant promise and grant to and with the said Gabriel Holmes his heirs Executors Administrators and assigns that before the ensealing and delivery hereof I am the lone sole and lawfull owner of the above Bargained premises and am lawfully seized and possessed of the Same in mine own proper Right and good perfect and absolute Estate of inheritance in fee simple and have in my self good Right full Power and lawfull authority to grant bargain sell Convey and confirm the said bargained premises in manner as aforesaid and the said Gabriel Holmes his Heirs Executors Administrators and assigns shall and may from time to time and at all times forever hereafter by virtue of these presents lawfully peaceably and Quietly Have Hold use Occupy possess and peaceably Enjoy the said devised and bargained premises with all the appurtenances free and Clear freely and Clearly acquited Exonerated and discharged of and from all manner of former gifts grants bargains sails leases mortgages wills entails jointures dowers judgments Executions incumbrances whatsoever Except the Quit Rents due as shall be lawfully demanded yearly as Reserved by the patent from the date of the said Patent. And I the said Edward Jackson do further covenant and bind my self my heirs Executors Administrators and every of them firmly by these presents To Warrant and forever defend the said Gabriel Holmes his heirs Executors Administrators and assigns in Quiet and peaceable possession of all and singular the said granted and Bargained premises against the just and lawfull Claim or Claims of any manner of persons whatsoever and for the Better(?) Strengthening(?) of the (?) of the aforesaid land I the aforesaid Edward Jackson doth oblige myself my heirs Executors administrators to make give my deed or Deeds as he the aforesaid Gabriel Holmes his heirs Executors administrators or assigns his or their Overseers in the law shall think meet or Requisite(?)
