Total of 26 pages (downloaded from www.fold3.com) going through 1853, but only pages 3-9 transcribed here; transcribed as written with my additions in brackets [ ]. *********** Pages 3-5, Declaration of Arthur Brown [Jr]: State of North Carolina, Sampson County, Court of Pleas & Quarter Sessions November term 1845. Personally appeared before the Court of Pleas and Quarter Sessions for the said County of Sampson. Arthur Brown a resident of the aforesaid County and State aged 48 years who being sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress passed on the fourth of July 1835(?) for the benefit of certain Widows. That he this declarant is the son of Arthur Brown deceased who served the United States in the war of the Revolution as a volunteer in the Cavalry and Infantry As this declarant has often heard him say, that he the said Arthur Brown lived in North Carolina where he was called into the service. That this declarant cannot tell who was his Father’s commanders, but that from the best of this declarants information and belief his father the said Arthur Brown served off an on through the said war as above stated both in the Horse and Foot companies as a volunteer. That the said Arthur Brown was married from the best of the declarants information in the year (1780) Seventeen hundred and eighty in the month of June to Lucy Butler. That the said Arthur Brown died in the month of November (1831) Eighteen hundred and Thirty-one leaving Lucy Brown his Widow surviving who died on the 22nd day of February (1844) Eighteen hundred and forty-four, leaving surviving her seven children to wit the declarant Arthur Brown Ann who intermarried with John Newman, Caleb Brown Mary who intermarried with Benjamin Bowden Dicy who intermarried with Redman Odom Sarah who intermarried with Harry Brewer and Margaret who intermarried with Reuben Reynolds the only surviving heirs of the said Arthur and Lucy Brown and all of lawful age. In further evidence of the said marriage the declarant herewith sends his Father’s original Family record, and that he believes it is in his Father’s own hand- writing, and contains the events as they transpired. Sworn to and subscribed on this the 17th day of November 1845 in open Court. [signed] Arthur Brown Test W. McKay JP I Thomas I. Faison Clerk of the Court of Pleas and Quarter Sessions for the said County of Sampson do hereby certify that it has been shown to the satisfaction of the said Court that Arthur Brown Senior did die in the month of November (1831) Eighteen hundred and thirty one. That Lucy Brown did die on the twenty-second day of February (1844) Eighteen hundred and Forty-four and left surviving her seven children - viz. Arthur Brown, Ann Newman, Caleb Brown, Mary Bowden, Dicy Odom, Sarah Brewer and Margaret Reynolds. The only surviving heirs of the said Arthur and Lucy Brown and all of lawful age. I also certify that it appears to the satisfaction of the said Court that the declarant (Arthur Brown) is a man of truth and respectability. In testimony whereof I Thomas I. Clover Garden Orange Co. NC July 21(9?) 1856 ******** Pages 6-7, Affidavit of Travis Butler: Stat[e] of North Carolina Sampson county. Personally appeared before me John Colwell one of the acting Justices of the pease for the said county Travis Butler a resident of the aforesaid county and State Aged Seventy three years who being sworn according to law doth on his oath make the following Statements in regard to the revolutionary servisis and marriage of Arthur Brown to Lucy Butler. That he the Said deponent is a brother in Law of the said Arthur Brown Decd and that he the deponant lived at the said Arthur Browns in time of the war and well Recolle[c]ts that it was said that he was gone in the Servise that he this deponant Staid with his sister who was the wife of the said Arthur Brown when he the said Arther Brown was gon[e] in the said war Sworn to and subscribed before me on this the 17 of November 1845 [signed] Travis Butler John Colwell JP I surtify that Travis Butler is a man of truth given under my hand on the above date John Colwell State of North Carolina, Sampson County I Thomas I. Faison Clerk of the Court of Pleas & quarter Sessions for the said County do hereby certify that John Coldwell whose name appears signed to the foregoing Affidavit and Certificate is & was at the time of signing the same an acting Justice of the peace for the said County and that the signatures purporting to be his are Jenuine. Brown was Born february the fifth 1812 of Dicey Brown. Additional Comments: Arthur Brown Sr. apparently died in 1830, not 1831, as his will was proved November Term, 1830 (copy of will and transcription available at USGW Sampson County archives). The delays and re-submissions between 1845 and 1853 were apparently due to the inability of the Duplin County court clerk to locate a record of Arthur Brown’s marriage to Lucy Butler, though this record is now readily available; and also to the difficulty of substantiating Arthur Brown Sr.’s war service, which has now been pretty extensively documented.
