Fortner of the County of Sampson & State of North Carolina Being of sound mind & memory but considering the uncertainty of my earthly existence do make & publish this my last Will and Testament in manner & form following that is to say Item 1st That my executor herein after named shall provide for my body a decent burial suitable to the wishes of my relations & pay all funeral expenses together with my just debts how so ever & to whom so ever owing out of the first monies that may first come into his hands as a parcel of my estate. Item 2nd I give and devise to my beloved wife Sureany (Serena Gregory) Fortner one third of all my lands that I now own or may own or be in possession of except (except my Clinton Lot) at the time of my death allowing her to choose three freeholders to lay it off including the dwelling house ___to have and to hold to her the said Sureany for & during the term of her Natural life or widowhood as her dower Item 3rd It is my will and desire that my beloved wife Sureaney choose three freeholders to set apart one year allowance for herself & family out of the Crop, Stock, and provisions on hand Item 4th I lend to my beloved wife Sureany during her life or widowhood one of my horses her choice (out of my lot) of all that I may own at the time of my death, two Calves, two Sows & Pigs, five head of Sheep all her choice, all my Poultry of every kind whatsoever on my plantation one bed bedstead & furniture her choice all my household & kitchen furniture not otherwise appropriated & my carriage & harness Item 5th I lend to my beloved wife Sureany during her natural life or widowhood my Negro boy named Baltimore Item 6th I give to my beloved wife Sureany all my wearing apparel of every kind whatsoever Item 7th I give and bequeath to beloved daughter Nancy Fortner my Negro boy named Giles one bed bedstead & furniture 2nd choice & my sideboard also one hundred dollars in money to be hand to her by my executor out of my money that may come into his hands as a part of my estate Item 8th I give and bequeath unto my beloved son William Fortner my lot and buildings thereon in Clinton adjoining & between the lot owned by Neill McGill & John W Robe which I purchased from Dr. Shaw as for reference to the deed will fully show One bed bedstead & furniture 3rd choice Also one shot gun his choice of my guns. Item 9th I give & bequeath unto my beloved son John Everett Fortner my Plantation on Roan Swamp where I now live adjoining William Williamson ^ others which I purchased from William Gregory reserving to my wife Sureaney one third part of said land during her natural life or widowhood as for reference to my title papers will more fully show It is my will & desire that my son John Everett have one of my horses the 2nd choice I give & bequeath to my son John E my Negro boy named Baltimore at the death of my wife or marriage which I have lent to her during that time Also at the death or marriage of my wife Sureany all the articles & property of every kind heretofore lent or given to her I give to my son John E I further give to my son John E one bed bedstead and furniture & my shot gun 2nd choice Item 10th It is my & desire that the balance of my property not heretofore disposed of shall be sold & after paying my just debts & legacies to be given to my beloved to my beloved son William Fortner And lastly I herby constitute & appoint my trusty friend J R Beaman my lawful Executor to all intent & purposes to execute this my last will and Testament according to the intent & meaning of the same & every part & clause thereof hereby revoking & declaring utterly void all other wills & Testament by me heretofore made In witness whereof I John E Fortner have hereunto set my hand and seal this 7th day of February 1851 Signed Sealed & declared by the said John E Fortner to be his last will & testament who at his request & in his presents subscribe our name & ___Langdon C Hubbard --Alfred Johnson John e. Fortner dec offered for probate & duly proven to be the act and deeds of the dec. & Sufficient in law to say his real & personal estate & J R Beaman the executor qualified and permit to act of. JR Beaman Clk. (NOTE) According to land deeds U.S. Census Records, recorded in Wayne & Sampson Counties N.C. John E. Fortner Sr. born 1794, was from Wayne County N.C. & that he was the son of Robert R. Fortner Sr. and his wife Jane Fortner (maiden name unknown) & that they lived on the South Side of the Yellow Marsh & on the Doctor's Old Road also called Dr. Bass's Old Road in Wayne County, N.C. Part of their land (1778-1825) bordered a place called the Great Pond also bordered Andrew Massey's land. Wayne County Index Book shows that the Yellow Marsh Branch starts near Brogden. Does anyone know the approximate location of this property? I am also looking for the names of the brothers & sisters of Amy, Matthew & Joseph Everett of Wayne County, N.C. about 1760 to 1840. If anyone can help me, I would really appreciate it.
