Sampson County, NC - Will & Estate Records Will of Minson Howard, 1864 (At the top of this will appears four stamps, each for 25 cents, has a picture of George Washington in the middle and the date August 21, 1869 written on them, top of stamps has "United States" and at the borrom, "Inter.Revenue") State of North Carolina } Sampson County } In the name of God Amen I Minson Howard being of Sound and disposing mind and memory blessed be god and while in the enjoyment of health desires to arrange my temporal affairs so that when death draws near I shall not be troubled about temporal affairs but may free from care prepare for another and a better world and consigning my body to the grave and my Soul to him who made all things do make publish and declare this paper writing thus Solemnly made to be and contain my last will and testament in manner and form as follows (To Writ). Item 1st I desire my Executrix Hereinafter named to pay all my just debts out of the first monies coming into her hands out of my estate. Item 2nd I hereby give devise and bequeath to my beloved wife Mary Howard during her life all my property both real and personal to hold use occupy and enjoy the same during her life time without let or hindrance and to have the rents hires and profits of the same. Item 3rd I give and bequeath to my beloved wife Mary Howard absolutely & without reservation all my household & kitchen furniture to dispose of in any way by gift sale will deed or otherwise as she may see fit. Item 4th I give and bequeath to my niece Spicey Cooper wife of John R. Cooper my negro woman Jane and her three children Susan Sarah and Edwin and all children said Jane may hereafter have or the said Susan & Sarah my have the said negroes to go into the possession of said Spicey Cooper after the death of my wife as a life estate in said negroes is given to my wife. Item 5th It is my will & desire that my land stock buggy & horse notes money and all other property which I may own beside the negroes given to Spicey Cooper and the Household & kitchen furniture given to my wife be divided after the death of my wife or such portion of the same as my wife shall not find necessary to live upon be divided among my heirs just as the law would divide it in case there had been no will by me made. In testimony whereof I have hereunto affixed my name this the 22nd day of October 1864 We have affixed our names Minson Howard as witnesses to this will in the presence of and at the request of the testator Minson Howard He having signed the same in our presence he being of Sound and disposing mind & memory and declaring the same to be his last will and testament Allmand A McKey } John H Crumler } ----- I Minson Howard have this the 3d day of July 1869 made & published this Codicil to my last will & testament in manner & form as follows (viz) After the death of my wife Mary Howard I give and devise to my nephew William T. Cooper one hundred acres of land to be cut of from the tract on Rye Swamp by running a line the same to be laid off by one man chosen by him & one man chosen by my exe or the Admr & if they fail to choose he may choose both men to hold the same to him & his heirs forever. 2nd I alter my will so as to give all the balance of my land to my wife Mary Howard should she outlive me to dispose of as she sees fit & to he hers in fee simple done in presence of Minson Howard A.M.
