Amen. I Jacob Newman of the County of Sampson in the State of North Carolina, being of sound mind, memory and understanding (blessed be God), knowing that it is appointed for all persons to die and after death to judgment do make and publish this my last Will and Testament in following manner and form. First of all, I recommend my soul to Almighty God who gave it, and my body to be decently buried in a Christian like manner by my Executors and friends. And as for my worldly affairs which it has pleased the Almighty God to bless me with, I give and bequeath in the manner and form as hereafter mentioned: 1st item: It is my request and desire that all of my just debts and funeral expenses first be paid. 2nd item: I lend unto my beloved wife, Mary Ann Newman, during her natural lifetime all the following property, all of my Negroes, namely Hannah, Tilly, Isham, Margerett, Thadius, Warity, Owen and Milton and all of their future increase. Also all of my stock of all kinds consisting of horses, cattle, hogs, etc., all of my farming tools all descriptions, all of my carts and carts wheels of all my household and kitchen furniture and my buggy and harness to be hers during her life time and after her decease to be disposed as follows, viz: 3rd item: I give and bequeath all of my before mentioned Negroes and their increase unto my four daughters to be equally divided among them to share and share alike, namely Anna Maria, wife of William Reynolds, Mary Ann, wife of Hanson (?) Huneycutt, Susan wife of William Huneycutt and Elizabeth A. Newman, to them and their heirs and assigns forever. 4th item: I give and bequeath after my wife’s decease unto my beloved son Archibald Newman and my four beloved daughters namely Anna Maria, wife of William Reynolds, Mary Ann wife of Hanson (?) Huneycutt, Susan wife of William Huneycutt and Elizabeth A. Newman the following property to be equally divided among them and share alike, viz all of my property that I am or may be possessed of at my death (except my negroes as heretofore given), consisting of all my stock of horses, cattle hogs, farming tools, carts and cart wheels, household and kitchen furniture, one buggy and harness to include all of my property that I have not heretofore given and bequeathed, to them and their heirs and assigns forever. Lastly, I hereby make and ordain my worthy friends Ollen (?) Royal and Isham Royal my sole executors of this my last will and testament. In witness whereof I the said Jacob Newman have to this my last will and testament set my hand and seal April the 17th AD 1858. I should be very glad to attend to this matter but as I am living so far off, if it is agreeable to the family I must decline to qualify as executor. Yours truly, Isham Royal. *********** Sampson County: In the Probate Court. In the matter of the Administration of the estate of Jacob Newman } Before James K. Morisey, Judge of Probate. John R. Smith being sworn doth say: That Jacob Newman, late of said County, is dead, leaving will testament; and that, the executors having renounced Hansen Honeycutt is the proper person entitled to Letters of Administration on the estate of the said Jacob Newman. Further, that the value of said estate, so far as can be ascertained at the date of this application, is about $300 (?), and that Anne Marian(h?) Runnelle, Hansen Honeycutt & wife Mary Ann, Susan Honeycutt, John R Fisher & wife Betsy Ann, Molsey Newman, Mary Ann Newman widow are entitled as heirs and distributees thereof. (signed)J. R. In the Probate Court A paper purporting to be the last Will and Testament of Jacob Newman deceased, is exhibited before me, the undersigned, Judge of Probate for said county, by Hansen Honeycutt, the executors therein named Ollen Royal and Isham Royal having renounced, and the due execution thereof by the said Jacob Newman by the oath and examination of Whitney Royal Jr the handwriting of Whitney Royal Sr. the other subscribing witness having been duly proven the subscribing witnesses thereto: who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Jacob Newman, That the said Jacob Newman in the presence of this deponent subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 17th day of April Ano 1858. And the deponent further saith, That the said Jacob Newman the testator aforesaid, did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him, and exhibited, to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said will, as an attesting witness thereto, and at the request, and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time fo the deponent’s subscribing his name as an attesting witness thereto, as aforesaid, the said Jacob Newman was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents say not. Morisey, Probate Judge Additional Comments: Apparently Jacob's son-in-law Hansen Honeycutt served as sole executor as both executors named in Jacob's will renounced. Anne Mariah(?) Runnells shown in probate docs would be the Anna Maria Reynolds listed in Jacob's will. Jacob's daughter Susan (Newman) Honeycutt may be a widow as of the probate as her husband is not listed. Betsy Ann is probably the Elizabeth A. listed in Jacob's will, who apparently married John R. Fisher between 1858 and 1869. Molsey Newman is possibly the widow of Jacob's son, Archibald, who was listed in the will but not listed as one of the heirs at probate 11 years later.
