Parker - Sampson County North Carolina Book 3 Page 464 Will of J.D. PARKER SR. - I Joseph D. Parker Sr. being of sound mind and disposing memory, but calling to mind the certainty of death, do make and publish this my last will and testament in manner audjorm following way: That I shall be buried in a decent and suitable manner and the expenses of the same shall be paid by my executor hence after named out of the first money that shall come unto his hands belonging to my estate. That my executor as soon as possible shall fully pay off and discharge all of my just debts of all value whatsoever. I give and bequeath to my daughter Martha (Mantra) J. Lockamon al the notes and accounts that I hold against her husband Thomas Lockamon. I give and bequeath to my son Joseph D. Parker Jr. all of my personal property of every description and volume whatsoever; also all that I have together with all indevers of every and all debts of whatsoever nature except those against Thomas Lockamon. I give and bequeath to my son Joseph D. Parker Jr. to him and his heirs in fee simple fifty shares in the Capital Stock of "The Cridon Loan Association" which I now own, evidenced by certificate No. 42 bearing date January 27th 1873 to have and to hold said Capital Stock to him the said Joseph D. Parker Jr., his heirs and assigns for ever. I give and bequeath to my son Joseph D. Parker Jr. to him and his heirs forever the lands that I and my wife Mary J. Parker have hencefore deeded to him to have and to hold said lands to him and his heirs and assigns forever. I give to my daughters Ellen S. McPhail, Zilpina A. Royal, Mary K. Smith, Margaret E. Newman, Sarah E. Cobb and Martha J. Lockamon and Laura Howard ten cents each. To my son James M. Parker ten cents. To my son Lucien E. Parker ten cents. I give and bequeath to my son Joseph D. Parker Jr. everything in the world that I now own or shall own at my death whatsoever my right in title shall be a present or the future right in title. I hereby revoke an declare nul and void any and all will in will and Testaments heretofore made by me is cause by me to be made and decalre and publish this as my only and last wil and will and testament. I hereby constitute, indain and appoint my son Joseph D. Parker Jr., my executor to convey and put in full force power and effect this my last will and testament with all power and authority of the same. Owen, John D. Ezzell State of North Carolina Sampson County In the Superior Court A paper purporting to be the last will and testiment of Joseph D. Parker Sr., deceased, is exhibited before me, the undersigned Clerk of Court for said County by Joseph D. Parker Jr. the executor hence mentioned and the executor ------- of by the said Joseph D. Parker Jr. is proved by the oath and examination of J.D. Ezzell and Thomas L. Owen the subscriber, witness thereof, who, being duly sworn each depose and say and each for himself, deferreth and saith that he is a substanting witness to the paper writing now shown here purporting to be the last will and testament of Joseph D. Parker Sr. that the said Joseph D. Parker Sr. in the presence of the defendant, subscribe his name of the end of said paper writing which is now shown as aforsaid and which been date of this day of And this deponent further said that the said Joseph D. Parker Sr. the testator, aforesaid, did at the time of subscribing his name as aforesaid declare the said paper writing is subscribed by him and exhibited to be his last will and testament and this deponerant did therefore subscribe his name at the end of said will as an attesting witness testator, at the request and in the prescence of the said testator. And this deponant further saith that the said time when the said testor subscribed his name to the last will and testament as aforesaid, the said Joseph D. Parker Sr. was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowldege information of this deponent; and further the deponent say not. Legally sworn and substantiated 23 rd day of December by me J.D. Ezzell Signed and Sealed by J.D. Ezzell & Thomas L. Owen The foregoing paper writen purporting to be the last will and testament of Joseph D. Parker Sr. is exhibited before me by J.D. Parker Jr. the executor therein named. and the same is shown to J.D. Ezzell and Thomas L. Owen the subscribing witness' ---- ---------- he due in exectin hence of by the said Joseph D. Parker Jr. is proven by the oath and exectutor. the said J.D. Ezzell and Thomas L. Owen, The said paper writing is thereupon admitted to probate and is abridged and declared by the court to be in all respect the last will and testment of J.D. Parker Sr. and as such is ordered to be recorded and filed - Whereupon upon applicable of J.D. Parker Jr. the exectuor mentioned in said will letter testimony even issued to the said J.D.
