In the first place to my eldest daughter Sarrah Hanes of the State of Tennessee I bequeath the sum of four hundred dollars out of my estate if she is still alive & if dead then the said four hundred dollars to equally divided among her children & no more. Item 2d I will & bequeath to my four grandchildren; John Westbrook, Sarah Byrd, Mary Piles & Wm. Westbrook Jr. children of my daughter Patsey the sum of fifty dollars each out of my estate. Item 3d I will & bequeath to my son John Tart what lands I let him have & also the sum of two hundred dollars which I have paid him & he has already rec'd. Item 4th I will & bequeath to my son Thomas Tart Jr. all the lands which I have given him to be his in fee simple also received the sum of two hundred dollars which he has not received out of my estate. Item 5th I will & bequeath to my son Nathan Tart all the lands which I have given him to be his in fee simple also to receive the sum of two hundred dollars which he has not received out of my estate. Item 6th I will and bequeath to my son James Tart all the lands which I have given him & for which he has deeds from me for I want said lands to be his & his heirs in fee simple forever & further my son James Tart owes me some money some of which I hold his notes for & some I have not & I want my said son James to be responsible & refund to my estate the sum of one hundred & fifty dollars & no more. Item 7th I will & bequeath to my daughter Nancy Denning all the money & property which I have heretofore given her & also the sum of forty dollars which she has not rec'd. Item 8th I will & bequeath to my daughter Pherebee McLamb all the money & property which I have heretofore given her & also the sum of forty dollars which she has not received. Item 9th I will & bequeath to my daughter Elizabeth McLamb all the money & property which I have heretofore given her & also the sum of forty dollars which she has not received. Also I will & bequeath to my four grand children the children of my daughter Patsey by John Ward Sr. the sum of twenty five dollars each to be paid out of my estate. Also it is my will & desire that after my executors have paid off the above named legacies that then the balance & residue of my estate be equally divided among my following seven children to wit. John Tart, Thos. Tart Junr., Nathan Tart, James Tart, Nancy Denning, Pherebee McLamb & Elizabeth McLamb share & share alike. And I do nominate & appoint my son James Tart & my friend Archibald Monk my executors to this my last will & testament. In witness whereof I here unto set my hand this 26th day of December 1848. All the executors A. Monk & James Tart therein named came into court & were duly qualified as executors whereupon it was ordered that the said last will & testament & this certificate of Probate be recorded in the Book of Wills.
