Sampson County, NC - Will of Ann Woodard, 1864 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ I Amy Ann Woodard of the County of Sampson and State of North Carolina being of sound mind and memory but considering the uncertainty of my existence do make and declare this my last will and testament in manner for me following that is to say. First that my Executors, here after named, shall provide for my body a decent burial suitable to the best wishes of my relations and provide and pay all funeral expenses together with my just debts howsoever and to whomsoever org__ing out of the moneys that may first come into thare hands as a part or portions of my estate. Item 1st I give and devise to my beloved daughter Amy Ann Harper and her lawful heirs following Negroes & Slaves__Tilla and Arnold and their increase to have and to hold the said Amy Ann Harper and her lawful heirs in fee simple forever. Item 2nd I give and bequeath to my beloved daughter the said Amy Ann Harper one feather bed bedstead and furniture her choice together all of my wearing apparel. Item 3rd I give and bequeath to my beloved daughter Matha Jane Keen one feather bed bedstead and furniture together with all my household and kitchen furniture, Item 4th my will and desire is that the resdue of my estate consisting of horses cattle hogs farming utensils corn fodder bacon etc. Should be sold and all debts owing to me be collected and if thare Should be any Surplus over and above the payment of my just debts that such Surplus Shall belong to my beloved to my beloved daughter Amy Ann Harper and her heirs forever. And lastly I do herewby constitute and appoint my trusty friends E. A. Bizzell and J. S. Eason my lawful executors to all intent and purpose to execute this my last will and testament according to the time intent and meaning of the same and every part and clause Therof revoking and declaring void all othe wills and testament by me hertofore made in testimony where of I the said Amy Ann Woodard do hereby set my hand and seal this 23rd April A.D. 1859 Amy Ann Woodard (Seal) Signed and declared by the said Amy Ann Woodard to be her last will and testament in presence of us who at her request in her presence and in the presence of each other do subscribe our names as Witness thereto. Averitte Thornton, Eleazer Rich. August Term 1864 ? This paper writing purportive to be the last will and testament of Amy Ann Woodard decd. Is exhibited for probate in open court by Everett A. Bizzell one of the executors named therein and the due execution thereof by the said Amy Ann Woodard is proved by the oath and execution of Averitte Thornton and Eleazer Rich. One of the subscribing witnesses thereunto It is therefore considered by the court that said paperwriting and every part thereof is the last will and testament of the said Amy Ann Woodard and the same is ordered to recorded and filed And therefore Julius C.
