JOHN SMITH, LAURENCE WALLER and wife, POLLY; ELIZA MANN; ALBERT SMITH; WHITSON 
CARTER and wife, JANE; GREEN SMITH, JULIA CLAYTON; MADISON, MARGARET and JANE 
CLAYTON, INFANTS OF JANE CLAYTON, deceased. 
                            vs.
CAROL SMITH and his wife, VINEY

Petition for Partition of Land

In this case, it appearing to the satisfaction of the Court that CAROL SMITH 
and his wife, VINEY,  do not reside in this State. It is therefore ordered by 
the Court that publication be made for six successive weeks in the North 
Carolina Argus, published at Wadesboro, notifying defendant, non-resident, to 
be and appear at our next Court to be held for the County of Stanly at the 
Court House in Albemarle on the 1st Monday in March next. Then and there to 
plead answer or demur to this petition filed. Otherwise judgment will be taken 
pro confesso and the matter heard ex parte to them. Witness EBEN HEARNE, Clerk 
of said Court at Office in Albemarle on the 1st Monday in September A.D. 1860.
