The Estate was probated in Stanly and Union Counties of NC. The Ledbetter family lived along what is now Ledbetter Ford Rd. near Rocky River. Will of Calvin T(homas). Ledbetter: Stanly County, North Carolina Will Book 5, pages 392-395. North Carolina, Stanly County. I, Calvin T. Ledbetter of the aforesaid County and State, being of sound mind, but considering the uncertainty of my earthly existance do make and declare this my last Will and Testament. 1st. My executor hereinafter names shall give my body a decent burial suitable to the wishes of my friends and relatives and pay all funeral expenses together with all my just debts out of the first moneys which may come into his hands belonging to my estate. 2nd. I give and devise to my daughters Ethel J. Ledbetter and Lila M. Ledbetter and their heirs the tract of land on which I now live together with all my personal property providing that the two daughters aforesaid mentioned shall well care for and maintain their Mother to-wit: Mary C. Ledbetter her natural life by them giving her body a decent burial. 3rd. I give and devise to my son, William S. Ledbetter, my land beginning at the bridge on the river and runs down the river to the mouth of a branch thence up the branch to his corner; thence about north to the highway; thence with the highway to the beginning. Also 2 acres of land known as the Perry School by name joining Vander Kennedy land. 4th. I give and bequeath to my son Gilliam C. Ledbetter, my land beginning at William S. Ledbetter North-west corner and runs Northeast to the center of a large Spring; thence with the mail road to the upper post oak on said road; thence about North to my old corner stake by two red oaks. Also I give to him my 2 business lots in Oakboro. 5th. I give and devise to my son, John B. Ledbetter, my land beginning at the rock corner in Jordon Huneycutt’s line, thence a South direction with the same degree of John B. Ledbetter line to the center of Rocky River. 6th. I give and bequeath to my two sons, Cornelius S. Ledbetter and Henry D. Ledbetter, the remainder of my tract of land lying in Furr Township bounded by Rocky River, Drew Morgan, Davidson Treece, and others. Said tract shall be equally divided between aforesaid sons. 7th. I give and bequeath to my daughter, Lugeny Griffin, my lot and house in the town of Monroe by her paying Ethel J. Ledbetter and Lila M. Ledbetter $200.00 in two years and $200.00 in four years. 8th. I hereby constitute and appoint my trusty friend, John M. Morton, and my daughter, Ethel J. Ledbetter, my lawful executors to all intents and purposes to execute this my Last Will and Testament according to the true intent and meaning of the same and every part and clause thereof, hereby revoking and declaring utterly void all other Wills and Testaments by me heretofore made. In Witness Whereof, I, the said Calvin T. Ledbetter, do hereunto set my hand and Seal this the 19th day of February, 1927. Calvin T. Ledbetter to be his Last Will and Testament in the presence of us, who at his request and in his presence do subscribe our names as Witnesses thereto. John M. Morton J. A. Tucker CODICIL North Carolina Stanly County. I, Calvin T. Ledbetter, of the aforesaid County and State, being still of sound mind and memory do hereby make and attach this as my codicil in manner and form as follows to my Last Will and Testament which was made February 19, 1927, and do declare the same to be part and parcel of said Will. It is my will and desire that should my beloved wife, Mary C. Ledbetter, dissent from said Will then in that event it is my will and desire that the lands willed to my beloved daughters, Ethel J. Ledbetter and Lila M. Ledbetter, shall be theirs to them and their heirs and assigns in fee simple free from any obligation for the support of their mother or other obligations to her expresses in paragraph two of said Will. 2nd. I hereby will and devise to my beloved son, Cornelius S. Ledbetter, the following described land; adjoining the lands of Davidson Treece and Drew Morgan and bounded as follows: Beginning at a stone on Rock Dam by 4 hickories and runs N. 801/5 E. 10 72/100 chs. To a stake by a post oak; thence N. 66 ½ W. 14 24/100 chs. To a stone at the head of a drain, a corner of lot No. 3 in Hunnycutt’s line; thence S. 17 W. 16 93/100 chs. To Treece’s corner; thence with two of his lines S. 81 E. 8 50/100 chs. To a stone; thence S. to 22 E. 29 75/100 chs. To middle of Rocky River; thence down said river to a point opposite a cedar corner on a bank; thence N. 2 E. 36 chs. To the beginning, containing 54 acres more or less. The same being all that part of C. S. Ledbetter’s land conveyed to him in paragraph six of my Last Will and Testament and all the balance of said lands included in paragraph six shall be to my son, Henry D. Ledbetter, and his assigns and heirs forever. In Witness Whereof, I hereunto set my hand and seal and do hereby designate and appoint my trusty friends, the original executors named in my said Will to carry into effect this my codicil to my said Will, every part and clause thereof. A Paper writing purporting to be the Last Will and Testament and Codicil of Calvin T. Ledbetter, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for the said county, by John M. Morton and Ethel J. Ledbetter the executors therein mentioned, and the due execution thereof by the said Calvin T. Ledbetter is proved by the oath and examination of John M. Morton, J. A. Tucker, G. Hobart and G.D.B. Reynolds, the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown to him, purporting to be the Last Will and Testament and Codicil of Calvin T. Ledbetter, in the presence of this deponent, subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears the date of the 19th day of February, 1927 and January 3rd, 1928. AND THIS DEPONENT FURTHER SAITH, That he said Calvin T. Ledbetter the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed byhim and exhibited to be his Last Will and Testament and Codicil, and this deponent did thereupon subscribe his name at the end of said Will and Codicil, and this deponent further saith that at the same time when the said testator subscribed his name to the said Last Will and Testament and Codicil as aforesaid, and at the time of the deponent’s subscribing his name as attesting witness thereto, as aforesaid, the said Calvin T. Ledbetter was of sound mind and memory, of full age to execute a Will and Codicil and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not. IN THE SUPERIOR COURT. It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the Last Will and Testament and Codicil of Calvin T. Ledbetter, deceased. Let said Will, together with the probate, be recorded and files. This 17th day of May, 1928. J. A. Little, Clerk of superior court. North Carolina, Stanly County. I, H. C. Little, Deputy Clerk of the Superior Court of said County and State, do hereby certify that the attached three sheets are true, perfect, and accurate copies of the Will and Probate of Calvin T. Ledbetter; that same are duly recorded in this office in Book of Wills No. 4, page 117.
