I, Joseph Marshall of the state of North Carolina and the county of Stanly County, being of sound mind and memory do make this my last will and testament as follows: I, first, will that all my just debts be paid out of my personal property and if there should not be enough out of my real estate, then in the 2nd and last place, I give all the remainder of my estate to Louisa Thomas Hearne, daughter of W.F. and Sarah Hearne-provided she lives to be married; if not to go back to P.W. Austin, my nephew. I also leave S.J. Pemberton my executor to see that this will is carried into effect. I also request my executor to improve and to hold this property in caqre. That she or her husband may be likely to waste it, I give him full control of it so that he may take proper care of it and let her use it as he may think best. Therefore, I leave him, my executor to control this thing as he may think best. J. Marshall There were no witnesses to the will. The Superior Court probated the will. L. Greene,I.W. Snuggs, Jas R.
