Anderson of county of Stokes and State of North Carolina on the first part and Thos M. Puckett of the said county and state of the Second part and Bitting and Francis and the estate of John H. Bitting of the third part Witnesseth that whereas David N. Anderson is justly indebted to the said Bitting and Francis in the sum of fifty one dollars and twenty four cents as are reference to 3 notes one given 10th Decr 1846 one 27th Decr 1848 one 19th Decr 1849 Also a debt of Judgnt arising to the estate of John H. Bitting deceased of forty five dollars and whereas the said David N. Anderson is honestly desirous to secure the payment of said debts. Now therefore this Indenture Witnesseth that for and in consideration of the premises together with the further consideration of of the sum of one dollar to the Said David N. Anderson in hand paid by the said Thomas M. Puckett the receipt whereof is acknowledged in full he the said David N. Anderson hath granted bargained and sold. and by these presents doth granted bargained and sold unto the said Thos M. Puckett a certain tract of land lying and being in the county of Stokes aforesaid on the waters of the Meadow branch adjoining the land of Isaac Ordens and Elizabeth Jackson containing two hundred and forty five acres more or less. Also 5 head of cattle 18 head of hogs 12 head of sheep 2 oat stacks 6 fodder stacks one fan mill 2 cubboard 3 beds and furniture 20 barrels corn all household and kitchen furniture one sorrel mare and one iron gray colt to have and to hold the said land and premises to him the said Thomas M. Puckett together with all the within named property this here executors and administrators in fee simple forever free and discharged from all incumbrency. Whatsoever in special trust and confidence. Nevertheless that the said David N. Anderson shall and will hold keep and use and apply the same to the uses and interest following and no other that is to say if the aforesaid debts and every part thereof together with the lawful Quota that may have accrued on the same shall not be fully paid off and satisfied on or before the 1st day of March next 1850. Then and in that case it shall be lawful and shall be the duty of the said Thos M Puckett being thereunto required by the said Bitting and Francis having first the same at least ten days at three public places in said county to proceed to sell the land and premises and other property to highest bidder for ready money and carry the same by proper assurancy to the purchaser and out of the proceeds or monies arising from said said sale retain all necessary expenses of said trust and the overplus if any they shall truly and faithfully return to the said David N. Anderson his executor or administrators. In Testimony whereof the said parties to these presents do herewith set their hand and seal the date appear first above written.
