Will of Benjamin Clements of Stokes Co. NC dated 1835 Stokes Co. NC Will Book Page 292-293 Know all men by these presents that I Benjamin Clements of the County of Stokes and State of North Carolina being now in my perfect mind and senses do make and satisfy this to be my last will and testament. In the name of God amen, and Itom [sic] 1st that all my just debts shall be paid out of my estate. 2nd That to my two deceased daughters Susan Cole and Letty Tucker I have given four Negroes each which the heirs have now got in possession also two beds and furniture. 3rd I give unto my youngest infant daughter Nancy John four negroes, one named Lewis, one named Larkin, one named Spenser, and one named Louisa, also one bed and furniture, also one thousand dollars in money, which is now in the hand of Abraham Scales Esqr. Now if the said Nancy John does not live to an age sufficient to receive the above legacy, I do will that it shall return to the heirs of Susan Cole and Letty Tucker, to be divided among them equally each heir to receive an equal portion with another. 4th. I do will that my land on the waters of Burch Stone creek and Dan river at my death shall be divided between the heirs of Susan Cole and Letty Tucker. Now in the division of these lands I do will that Letty Tuckers two children shall receive as much as Susan Coles eight. 5th. I do will that my wife shall have the use of the tract of land that I now live on during her life of widowhood, also I lend unto her so much of my livestock, household and kitchen furniture, farming utensils as she may think proper to retain for the use of carrying on the farm to support her. The balance if any to be sold and applied to the payment of my debts, or divided among the heirs above named. I also lend unto her two negroes, a man named Buck, a woman named Charlotte during her life of widowhood and then at her death or marriage to be sold and divided among the heirs of Susan Cole and Letty Tucker in the same manner as the lands above named, the track of land that I now live on at the death or marriage of my wife to be divided or sold, and divided among the heirs of Susan Cole and Letty Tucker in the same manner as the land on Burch Stone Creek and Dan River. The two youngest negroes that I leave to my daughter Nancy John being to small to hire out, I will that my wife take them, say, Spencer and Louisa and keep then until they are large enough to hire out and that she shall be paid a reasonable allowance for their support. The stock on hand with the land at the death or marriage of my wife to be sold and divided with the land in the same manner. I do hereby nominate constitute and appoint William C. Cole and John Griffin my Executors to this my last will and Testament.
