Surry County, NC - William Moore - Act to Divide Real Estate ~~~~~~~~~~~~~~~~~~~~~~~~~~ An Act to appoint commissioners to meet certain commissioners, to be appointed by a corresponding act of the Legislature of Virginia, to divide the real estate of William Moore, deceased among his heirs Whereas William Moore, decd. late of the county of Patrick and state of Virginia, died seized and possessed of considerable real estate, lying and being within the limits of this state and the state of Virginia, and whereas by dividing the several tracts of the said estate into such small parcels as required by the laws of this state and of Virginia, would tend greatly to the injury of the heirs of the said William Moore deceased. Be it therefore enacted by the General Assembly of the State of North Carolina, and it is hereby enacted by the authority of the same, That Elijah Harris, John Whitlock, Mallory Smith, James M'Craw and William Slade, be, and they are hereby appointed commissioners to meet certain commissioners who may be appointed by the Legislature of the state of Virginia at such time and place as may be agreed on by the said commissioners or a majority of them, and with them to divide among the heirs of said William Moore deceased, all the real estate lying and being within the limits of this state and the state of Virginia, agreeable to what they may think equitable and right. And be it further enacted by the authority aforesaid, That the said commissioners are hereby required as soon as may be, to proceed in conjunction with the said commissioners who may be appointed on the part of the state of Virginia, being first sworn to do justice between the heirs according to the best of their skill and ability, to divide among the said heirs the real estate aforesaid, in manner aforesaid, and make return of their proceedings under their hands and seals, ascertaining with precision the different tracts or parcels of land alloted to each of the said heirs, to the court of pleas and quarter sessions for Surry county, and state of North Carolina, which return shall be certified by the clerk and enrolled in his office and registered in the register's office of said county, and such return shall be binding and valid between the said heirs and their assigns forever.
