This Indenture made this twenty third day of April in The year of our Lord one thousand eight hundred and In the twenty fifth year of the sovereignty and indepen- dence of the United States of America between Tho- mas Hutchens of the County of Surry and State of North Carolina of the one part and James Smith of the County and State aforesaid of the other part witnesseth that for and in consideration of the sum of one hundred and seventy five pounds current money to me in hand paid by the said James Smith the re- ceipt whereof is hereby fully acknowledged, I the said Thomas Hutchens doth give grant bargain and Book H 305. sell unto the said James Smith his heirs and assigns for- ever a certain tract or parcel of land lying & being in the County aforesaid on the waters of the North fork of Deep Creek on the North side of said Creek thence down the same as it meanders sixty nine chains and seventy five links to a Beach thence North two chains thence West to the beginning It being part of the six hundred and forty acres sur- veyed to James Reece January twelfth day 1779. containing by estimation forty acres more or less to have and to hold the foresaid land with the appur- tenances and all rights priledges and improvements to the same in any wise belonging to the said Thomas Hutchens and his heirs and assigns for ever, and said Thomas Hutchens for himself his heirs and assigns doth hereby covenant and agree to and with the said James Smith he the said James Smith his heirs and assigns shall and may for ever hereafter peaceably and quietly have and occupy possess and enjoy the afore granted land and premises without the let- or molestation of any person or persons and free and clear from all incumberances whatsoever the said Thomas Hutchens doth oblige himself his heirs executors and administrators to warrant and defend the aforesaid granted land and premises to him the said James Smith his heirs and assigns for ever. In whereof I the said Thomas Hutchens have hereun- to set my hand and affixed my Seal the day and year above written.
