It also speaks of the Revolutionary War Service of HIS FATHER - ISSAC NICHOLSON, of VA who served from Surry Co., NC also of Surry County (later Stokes). There is no mention of wife nor children, but in his later years he was in the guardianship of a 24 year old man named Edward H. Moore. §§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§ State of North Carolina } Stokes County } SS On the 5th day of October 1844 Personally appeared before me Edmond L. Martin, a Justice of the Peace and quarter Sessions in and for the county aforesaid James Nickleston a resident of the county aforesaid aged 82 years and being first duly sworn according to Law doth on his oath, make the following declaration in order to obtain the benefit of the Act of Congress, passed June 7th 1832 that he entered the Service of the United States as a Volunteer and served as herein after stated (Viz) he was a resident of the county of Surry, (now Stokes), NC. He left his home with his father Isaac who was a regular soldier in the service of the United [States] at home on furlow as well as he can recollect about the year 1781 and went with the said Isaac to Duplin Court house NC where the army was then stationed; I there joined the troops as a volunteer to Capt. Mann; that I was enrolled with I do not now recollect though a man by the name of Rayford was our Major; the [other?] name of the eighty I cannot recollect and after staying there some time the army was divided and my father Isaac was sent some where near Charleston South Carolina and I still remained at Duplin Court house and afterwards was taken by our Major Rayford as a servant or a Trainer of our horses, and frequently cooked and sometimes washed for our mess from that time untill the close of the war, which was as well as I now recollect 15 months from the time I joined the army at which time my father being discharged come by after me when we returned home together. To now state where I now live and have ever since, the officers who I was under and those of our mess believe Major Rayford Captain Hauley, Hill and Lamb. and Col. name as well as I can recollect was Tinson McRea; I was not in any engagements neither was the troops where I was stationed that I now can recollect. I was marched from Duplin Court House to a little village by the name of Elizabeth Town where I was takin sick and left by the main army where I remained for some time before I obtained my health sufficient to do duty though on the recovery of my health, I again returned to my duty and performed the Service required of me untill the close of the war when I was honourably discharged, and the army was disbanded for further information he would refer the department to the annexed affadavit he hereby reliquishes every claim whatever to a pension or annuity Except the present, and declares that his name is not on the Pension roll of the agency of any State as (If any) only on that of the agency of the State of N.C. [signature with drawn seal] James [his mark] Nickleston ____________________________________________________________________ Question 1st Where and in what year was you born Answer: I was born in the County of Albemarle, Virginia the year I don't recollect Have you any proof of your years of age, if so where is that. Answer: I have none Question 2. Where were you living when called into the Service, Where have you lived since the revolutionary war, and where do you now live Answer: I was living in Surry County, NC, now Stokes When I went into the Service and still live in said county. Question 4 [sic] How were you called into the service, were you drafted, did you volunteer or were you a Substitute, and if so for whom Answer: I volunteered Question 5. State the names of some of the officers who were with the troops where you served &c Answer: the name of the officers and General circumstances of my service is set forth in the body of the declaration. With the exception of Capts. Rhodes and McRea Question 6. did you ever receive a discharge from the service and if so by whom was it given and what has become of it Answer: I rec'd a discharge at the close of the war (I think Major Rayford give it to me, at Duplin Court House or near there, I cannot exactly recollect, as the army was disbanding and rec'd their discharges at various points in which has since been lost or misplaced. Question 7. State the name of Persons to Whome [sic] you are known in your present neighborhood and who can Testify to your character for varacity and their belief of your service as a soldier of the Revolution Wm M. Reeves and Wm Wood - John James The applicant further states that it would be [illegible] with a great deal of trouble and expense for him to obtain the certificate of a clergyman as there is no one acting in that capacity in his neighborhood and that from Bodily infirmity he is not able to go to court to make this declaration without very much endangering his health Which is very delicate. To the Truth of which I concur. E.L. Martin J.P. (signature) The applicant further states that the cause of his not applying for a pension sooner was that he had intended to try and live without it. But from old age and infirmity he has been compelled to ask aid from that country for which he served. We the assigined do certify that we have been personally acquainted with James Nickleston for some 39 years. As for Wood - 15 or 20 years and believe him to be a soldier of the revolution as he has set forth in his declaration. A man of varacity and truth and that he was a solider of the revolution we never heard it disputed. Given under our hands and seals the day and state first written. E. L. Martin J.P. N. page 85 ____________________________________________________________ State of North Carolina } County of Stokes } SS On this the 2d day of April AD one thousand eight hundred and fifty five personally appeared before me a Justice of the peace within and for the county and State aforsaid Edward H MOORE, aged twenty six years a resident of the county of Stokes in the State of North Carolina who being duly sworn according to Law declares that he is the lawful guardian of James Nickleston who was a private in a company commanded by Captain [blank] in the [blank] regiment of [blank] Commanded by Col. [blank] in the war of the Revolution that his ward, the said James Nickleston is now a Revolutionary pensioner of the United States at the Rate of $52,68cts as will more fully appear by reference to the said Jas Nickleston pension certificate on file at Washington City in Book E Vol 6/2 page 69 and dated on the 21st day of Feb AD 1853 which he thinks is conclusive proof of his ward's service in said war he makes this declaration to obtain the bounty land to which his ward, the said James Nickleston may be entitlled[sic] under the act approved march the 3d AD 1855. He also declares that he has not received a warrant for bounty land under this or any other act of Congress nor made any other application therefore. Ed H MOORE [signature] Guard. We, Elisha SMITH and T BLACKBURN, residents of the County of Stokes in the State of North Carolina upon our oaths declare this the foregoing [text missing] Know all men by these presents that I James Nicholson of the county of Stokes State of North Carolina do hereby constitute and appoint George C. Ames of Washington DC my true and lawfull attorney for me and in my name to examine into & present my claim for any amt of Revolutionary pension which may be due and I hereby authorise my said agent or attorney to examine all the papers & documents in relation to said claim or file in the department at Washington City or elsewhere to file additional evidence and to do all things that I myself would do if personally present - Hereby certify if and confirm if all that my said agent or attorney shall lawfully do in the process - Witness my hand & seal this 23rd March 1852 Signed sealed and } James (his x mark) Nicholson {Seal} delivered in presents of } R.J.
