Surry Co., NC, Will of Lewis Atkins, dated 15 Sep 1854, Proved May 1863 Transcribed from copy received from NC State Archives Submitted by: Melanie Atkins ratkins@tca.net I Lewis Atkins of the County of Surry and State of North Carolina Being of Sound mind and memory but considering the uncertainty of my Earthly Existance Do make and Declare this my Last Will and testament in manner and form following that is to say First that I Bequeath to my Beloved Wife Manerva Atkins All of my Land Situated on Codies Creek in sd County and all of my horses Cattle Hogs and Sheep and All of my Farming tools and Also all of the various kinds of Tools which I have Also All of my house hold and Kitchen furniture Also all of my crop of corn fodder rye oates hay & together with Every thing that I have or may have at the time of my Decease After Paying all of my Just Debts which must be paid the Remaining portion To her alone to do with as She thinks proper and Lastly I do hereby constitute and appoint my Trusty friend James C Snow my lawfull Executer to all intents and purposes to execute this my last will and Testament according to the true intents and meaning of the same and every part and clause thereof hereby Revoking and declaring utterly void all other wills and testaments In witness whereof I the Said Lewis Atkins do hereunto Set my hand and Seal this the 15th day of September AD 1854 Lewis (his X mark) Atkins Signed Sealed and (³delivered² crossed out) declared by the said Lewis Atkins to be his last will and testament in the presants of us who at his request and in his presants do subscrebe our names as witnesses thereto Thoıs Nixon Martha Wilmoth State of North Carolina Surry County Court May Term 1863 The executor of the within last Will and Testament of Lewis Adkins decıd was duly proved in open Court by the oath of Thomas Nixon & Martha Wilmouth the subscribing witnesses thereto and is ordered to be Recorded and filed H C Hampton CCC
