Will of Samuel Vance, 1789 In The Name Of God Amen: I, Samuel Vance of Surry County in the state of North Carolina, being sick of body but sound in mind and memory, calling to mind the mortality of my body and knowing that it is appointed all men once to die; do make this my last will and testament, utterly revoking all wills by me formerly made. Principally and first of all I give and recommend my soul to Almighty God that gave it, and my body to the Earth to be buried in decent christian order at the discretion of my excutors; nothing doubting but at the general resurrection I shall receive the same again by the Mighty power of God and as touching such wordly estate it hath pleased God to bless me with; I give and devise and dispose in the following manner and form-- First, I give and bequeath to Aley, my dearly beloved wife, the sole core and management of my estate during her widowhood and no longer, and to my son David Vance, five shillings and to my son, Nathaniel Vance, five shillings and to my son Samuel Vance, five shillings and to my daughters, Sara Endsley and Hanah Lowery, five shillings each and to the remainder of my sons and daughters, I give and bequeath my whole estate to be divided amongst them in the following manner, to my daughters, Alice and Elizabeth, I give and bequeath a part equal to Sarah and Hanah and to my three youngest sons, James, John and Joseph Vance, the remainder of my estate equally amongst them by the concent of my wife, so long as she continues a widow; but in case my sons, James and John or either of them shall leave their mother under age, except in marriage, they shall be portioned equal to my three oldest sons, and in case my wife shall marry, she shall only have one eleventh part of my estate, but so long as she continueth single she shall not be deprived of her maintenance during her life. Ratifying and confirming this and no other to be my last will and testament. In witness whereof I hereunto set my hand and seal this 29th day of March in the year of our Lord Christ one thousand seven hundred and eighty nine. Samuel Vance(X) Witnesses:John Cummings Abraham Endsley At bottom of will is this: Be it knkown to all men by these presents that I Samuel Vance of Surry County have made and declared my Last Will and Testament in writing bearing date the 29th of March 1789. I, said Samuel Vance, by this present codicil, do testify and confirm my Last Will and Testament and do further give and bequeath unto my loving son, Joseph Vance, twelve pounds good and lawful money of North Carolina in Gold and Silver, to be paid our of my estate and to be given for his schooling over and above his part aforementioned in my will and said money to remain in the hands of my executrix which I do constitute to be my beloved wife and John Lowery and my will and meaning is that this codicil be adjudged to be amply performed in every respect as if the same will so declared and set down in my Last Will and Testament.
