Maarbjerg In the Name of God Amen. November the first Day one Thousand Seven Hundred & fifty one I Thomas Lee of Tyrrel County in the province of North Carolina Gentman being very sick & weak in body but of perfect mind & Memory thanks be given to Almighty God; Therefore calling into mind the Mortallity of my body & the uncertainty of this Life and knowing that it is appointed for all Men Once to Dye, Do make & Ordain this My last Will and Testament that is to Say principally & first of All I Give & Recommend my Soul into the hands of God that gave it; and my body I Recommend to the Earth to be buried in a Decent and Christian Burial at the Discretion of my Executors; Nothing doubting but at the General Resurrection I Shall Receive the Same again by the Merits and the Grace of God; And as Touching Such Worldly Estate ...........[line smudged out]... the Same in the following manner & forme. Item. I give and bequeath to Elizabeth my beloved Wife one Negro Woman Named Amy and One Negrow boy Named Abros Son of Said Amy, together with my New Riding Horse. Item. I Give & bequeath to my Said Wife the fifth part of all my personal Estate. Item. I give & bequeath the residue of the remaining part of my personal Estate to be Equally Divided among my four Children, to wit, Isaac, Mary, Francis & Thomas but in Case my Said Wife shall bring forth another Child or Children by Me begotten then in Such Case Such child or Children to be Cosharers & Equal with my Said four Children in the aforesaid Remaining part of my personal Estate. Item. I give & bequeath to My Eldest Son (to wit) Isaac aforementioned all my lands lying on the South east Side of Connbee Creek in Said County, exclusive of the parcel of land called Grits & Savory's, together with my plantation lying on the West side of Welsh's Creek known & Called by the Name of My Cow- pin, and the land thereto belonging. [line smudged out. ......above mentioned My parcel of land lying on the North East Connbee Creek aforesaid known by the Name of Grits & Savorey's together with Half of the Uper tract of land which is jointly between Me and My Nephew Stevens Lee to him and the Said Francis and his Heirs for Ever. Item. I give and bequeath to my youngest Son Thomas Abovesaid the plantation whereon I now Dwel together with all My lands lying between Connbee Creek and Marratock [now Roanike] River and also the parcel of Land to me belonging And lying on the West side Welsh's Creek below Joseph Hudson's to him the said Thomas and his Heirs for ever. And I constitute Make & Ordain My trusty and beloved Friends Francis Brice Esq of Duplin County, Cap'n. William Mackey & Stevens Lee of Tyrrel County above my full Executors of this my last Will & Testament; And I Do hereby disalow, Revoke & disannul all & Every other or former Will, Legacys and Testaments ............ whereon I hereunto Set my hand and seal as of the date first mentioned above. Thomas Lee Signed Sealed pronounced and Declared By the Said Thomas Lee as His last Will & Testament In the presence of John Nicholls William Barrett James Rhoads North Carolina Tyrrel County County Court Anno Dom. 1753 Present His Majestys Justices These may certify that William Barrett one of the subscribing Evidences to the Within Will appeared in open Court and made oath on the Evangelist of almighty God that he was present and saw Thomas Lee Deceased sign, seal, publish and Declare the within writing to be and contain his last Will & Testament and that he was then and at that time of sound and Disposing Memory and that he saw John Nicholls and James Rhoads the other subscribing Evidences sign their names thereto at the same time.
