I MARY SPRUILL of the County of Tyrrell and State of North Carolina considering the uncertainty of this mortal life, and being of sound and disposing mind, and memory, do make and publish this my last will and testament in manner and form following (that is to say) first, I give and bequeath untoWOOLEY, the son of my niece FANNY HATHAWAY, one feather bed and furniture to him and his heirs forever I give and bequeath unto JOSEPH, the son of said niece one bed and furniture to him and his heirs forever I give and bequeath unto WILLIAM another son of my said niece one feather bed and furniture to him and his heirs forever I give and bequeath unto BENJAMIN the other son of my said niece one feather bed and furniture to him and his heirs forever I give and bequeath unto my nephew BENJAMIN BOULTON one feather bed and furniture to him and his heirs forever It is also my will and desire and I do hereby devise unto my said nephew the yearly sum of fifty dollars to be paid him during the term of his natural life each and every year by my Executors hereinafter named I do lend and loan unto my niece ELIZABETH (the daughter of my sister MRS. BULLOCK) a negro woman named MARGARET during this natural life of my said niece and after the death of said niece I devise and bequeath the said negro woman MARGARET and her increase to the children of my said niece ELIZABETH to be equally divided amongst them share and share alike and to their heirs forever. I do give and bequeath to my niece FANNY HATHAWAY my horse and chair, clock, and pare of looking glasses to her and her heirs forever and further I do lend and loan to my said niece FANNY HATHAWAY for and during the term of her natural life the use and occupation of the land and plantation whereon I now live, with the land belonging to me that is thereto attached and after the death of the said FANNY HATHAWAY it is my will and desire and I do give, devise, and bequeath the aforesaid plantation and land unto WILLIAM HATHAWAY the son of the said FANNY and to his heirs and assigns forever; but in case the said WILLIAM HATHAWAY should not survive the said FANNY (his mother) and in case he should die before he arrives to the age of twenty one years without lawful heirs of his body; then it is my will and desire and I give, devise and bequeath, the aforesaid plantation and land unto BENJAMIN HATHAWAY, the son of the said FANNY, and to his heirs and assigns forever; but in case the said BENJAMIN should not survive the said FANNY HATHAWAY (his mother) and in case he should die before he arrives to the age of twenty one years and die without lawful heirs of his body; then it is my will and desire and I do give, bequeath and devise the aforesaid plantation and land unto the children of my said niece FANNY HATHAWAY, and to their heirs and assigns for ever. It is further my will and desire and I do loan and lend unto my niece FANNY HATHAWAY during her natural life the use of the five following Negroes, to wit, JESSE, OLD MID, WINNY, and her child MID, and CHARLES and after the death of said FANNY it is my and desire and I do hereby give and bequeath the aforesaid negroes to the children of the said FANNY, and to their heirs and assigns forever, to be equally divided amongst such as may be then living share and share alike. And I do give devise and bequeath unto my Executors herein after mentioned the following negroes, to wit, ISHMAEL, JACK, LEWIS, DANIEL, BUSTER, FRED, AFRICA, BET, NELL, MATILDA, ALFRED, LAVINIA, and MILES in trust to be by them hired out from year to year, and the proceeds thereof to be appropriate to the payment of the annual legacy before devised to BENJAMIN BOULTON, and to the payment of the yearly sum of one hundred dollars to FANNY HATHAWAY during her natural life, and the residue of said hire to be appropriate to the support and education of the children of the said FANNY HATHAWAY and I do further give devise and bequeath the aforesaid thirteen negroes to the children of said FANNY HATHAWAY and their heirs forever in the following manner, that is to say, that my said Executor shall allot and set off and put in ??? of each of the said children as they arrive to lawful age one share of the said negroes and it is further my will and desire that my said Executors, sell all the other property belonging to my Estate, not herein devised or bequeathed, and appriate such part as may be necessary to the payment of my debts, and the balance to appropriate to the use of the children of FANNY HATHAWAY, my said niece aforesaid I do further give and devise unto my said niece FANNY HATHAWAY all the furniture and stock which I bought belongong to WOOLEY HATHAWAY, now in the pop pins And lastly I do nominate, constitute and appoint my worthy friend JOHN POPILOTON? and my nephew WILLIAM BULLOCK Executors to this my last will and testament hereby revoking all others with by or heretofor made in writing whereof I have hereunto set my hand seal at Edenton this twenty sixth day of November in the year of our lord one thousand eight hundred and eighteen.
