STATE OF NORTH CAROLINA    COURT OF PLEAS & QUARTER SESSIONS      Union County
July Term, 1856

JOHN STEWARD and JOHN McCAIN, Executors of ANDREW McCAIN, deceased
                         vs.
HOSEA McCAIN, HUGH W. McCAIN, R. W. STACIE and wife, JANE; JOHN RAPE, Adm'r of 
MARTIN RAPE; J. J. WILLIAMS, Adm'r of JAMES & ELEANOR HERKEY, and others

In this case, it appearing to the satisfacvtion of the Court that the 
defendant H. W. McCAIN, resides beyond the limits of this State: It is 
therefore ordered by the Court that publication be made for six successive 
weeks in the North Carolina Argus, a newspaper published in the town of 
Fayetteville, notifying said defendant, non-resident, to be and appear at our 
next Court of Pleas and Quarter Sessions to be held for the County of Union at 
the Court House in Monroe on the 1st Monday in October next. Then and there to 
please,answer or demur to this petition filed. Otherwise, judgment will be 
taken pro confesson and the matter will be heard ex parte as tohim. Witness J. 
M. STEWART, Clerk of the said Court at office in Monroe, on the 1st Monday of 
July A.D., 1856.
