OSBORN and W.H. SIMPSON THIS INDENTURE Made the 24th day of Aug. 1875 between WILLIAM ELLIOTT & wife ELLEN ELLIOTT of the County of Union and State of North Carolina on the first part and W. S. OSBORN and Wm. SIMPSON of the County of Union and State of North Carolina on the other part. Witnesseth that for and in consideration of the sum of one hundred Dollars to them in hand paid by the said W.S. OSBORN and W.H. SIMPSON, the receipt and payment whereof is hereby acknowledged and therefore doth relieve against & discharge alien confirm convey unto the said W.S. OSBORN and W.H. SIMPSON their heirs and assigns forever all that piece or tract of land or all their divided or undivided interest in said tract of land lying & being in the County of Union and State of North Carolina on the waters of Lane's Creek being a part of ELIZABETH ELLIOTT's dower of BENJAMIN WILLIAMS. Beginning at a dogwood on the bank of Lane's Creek, and runs N. 11 W 74.07 chains to a stake in JOB WILLIAMS line then S 51W 17 .07 chains, his corner R.O. then N 11 & 25 chains to his other corner then S.23 W 42. 50 chs. to B.O. MATTUCK'S Corner, thence S51 W 19 chs to a W.O. then S 34.22 chs to a pine by 3 R.O. then S. 72 W 12.50 chs to a stake by a pine & P.O. then S. 53 and 9.75 chs. to a stake by a P.O. & 2 pines then N. 80 & 111.31 chs to a hickory & P.O. then S. 55 W 2 chs thence S. one W. 19 chs. to a P.O. on the Bank of Lane's Creek, then down the various courses of the creek to the beginning containing two hundred and seventy five acres more or less to have & to hold the aforesaid three fifths of sd. tract of land being the undivided interests of B.H. WILLIAMS, L. A. WILLIAMS and JOB WILLIAMS, who had conveyed all their interest in said tract of land to JOHN ELLIOTT with all houses orchards and improvements waters water courses together with all and singular & the appurtenances thereunto belonging or in any wise appertaining unto them the said W.S. OSBORNE & W.H. SIMPSON their heirs and assigns forever Reversions remainder of the aforesaid land & premises and every part thereof & all tlhe estate right title, interest claim and demand whatsoever of the said WILLIAM ELLIOTT & wife ELLEN ELLIOTT in and to the lands & premises hereby granted to have & to hold te aforesaid land & premises with the appurtenances unto said W.S. OSBORN & W.H. SIMPSON & their heirs & assigns forever and the said lands & premises and eveery part thereof do warrant & defend against themselves and their heirs & no further whatsoever In testimony whereof we have affixed our seals the year and day above written. 24th August 1875. WALKUP, Judge of Probate for Union County by WM. ELLIOTT & ELLEN ELLIOTT his wife the grantors therein for the purposes therein mentioned and thence from the said ELLEN ELLIOTT, wife of the said. WM. ELLIOTT was by me separately and privily examined & upon _____her examination separate & apart from her said husband acknowledged that she executed said conveyance of her own free will & accord, without any fear, force or compulsions from her said husband or any other person and that she doth still willingly and freely assent to the same.
